Just as an update if anyone is interested in the original thread.... My DOM had a copy of the post on here, that had named and shamed him.
He had me escorted from the premises and i was told that i was never welcome again on Royal Mail property.
He wouldnt let me work out my notice and informed wages that i left the previous day!! He also said that he would not put my overtime for that week through as i didnt deserve it because of what i had said about him!!!!!!
Not sure if this is correct proccedure, dont think it is.
Anyway copies of original message and conversation between my DOM and I have been sent to the head of diversity and he ensured me via email that the matter will be looked into.
Have to wait and see i guess.

failure to pay overtime is illegal witholding of wages under wages act 1992 - take RM to ET to recover them

I would think that any withholding of wages is illegal but RM seem to think that they are above the law.

Can any independant witness corroborate this story, as it smells fishy.
DOMs are EL2s at most, and often ML3s or even ML4s, and don't have the powers to "sack" anyone like this unless they're temp or agency staff.
They could recommend termination and suspend from duty, but IF he did the things you say, he's looking at a red bike job again, as he would have over-stepped his mark.
Why didn't you get the union or Personnel involved?
Apart from the stupidity of posting manager's names and allegations on a web-site, how could he (or RM) terminate your employment without investigation? It might have been someone else posting in your name.

Go see your union rep /area rep belive thats bordering on constructive dissmisal he's no right to sack you on the strength of an article written by you or some else until he's gone through the courts and secured a judgement against you etc.... only then could you be dissmised

there could be posibilitys of suspension but it would be on full pay

Thats my point exactly, he has tried to cover himself my phoning wages and telling them that i have left the day before.
On the union front, i was so shocked from being ejected from the premises that i have contacted them after the event, i have also been in email contact with the head of diversity and inclusion who reports directly to the senior management.
I dont expect to get any joy, even if it only in the form of recognition for the way the place is run, that will be a start.
I did point out that i have a shared computer and even if it could be proved to be sourced from my pc at home, he would still need to prove that i posted it. His response was that he doesnt need proof, he cam terminate my employment any time he sees fit!! and i took a witness in to this discussion.
I am hoping that this isnt the case, i think he has let his emotions interfere with his managerial dessision in this case.
I know what your thinking...manager...emotion... i am as shocked as you!!!

I can well believe RM Management can be very spiteful, extremely territorial & vindictive, they have their own little empires and take things very personally and tend to be very unprofessonial .

The most bolshy & militant union is in actuality is the unofficial manager's union . It's just with a different twist . Union or wannabe Union reps who've crosssed over to the other side in a suit with the mandatory chip on the shoulder throwing the book at people and the CWU throwing it back at them according to the Sawyer Report on RM's dire Industrial Relations .

Not many people like Whistleblowers or just plain taking things outside the building with RM ??? . If there is a geniune OSA issue , if anyone is to frogmarch staff off the premises it should be the IB ??? .

His arrogance MAY be his achilles heel though .I'd summise that DOM thinks he's going to be backed up all the way to Old Street especially with the suspensions in Scotland for going on here , but unfortunately the cat is out of the bag .

These people tend to be too obtuse but that's their problem .

I've seen similar things happen in another ex nationalised industry when it was a sackable offence under Section A Employment & Discipline . This was according to Management "To button up your mouth "--the reasoning was too many reps were writing too many letters to the papers .

To be fair there was a section at the Dept of Transport , Marsham Street which highlighted cases to put across the case for Government Privatisation . Couldn't have these people being put back in uniform or on the dole could we now ? instead of a management structure that operated for the benefit of the manager's inside it & jobs for the boys .

Can't see any of that standing up in a ET even with RM's bent solictors trying to make black appear white .

Trouble is, even discussing it on here isn't helping your case and if RM did sue for liable (which they may well do if you push this case), you could end up bogged down by a very expensive and drawn out legal battle which you could well lose, and badly. Its very difficult to do battle with RM on some levels and if you're just glad to be out, then it might be cheaper to just get on with your life. Seek legal advice before you do anything rash.

Thanks guys, i am glad for the support, i was backed into a corner, and was quite happy to just leave with my head held high, until the management started their bullying tactics at the last hurdle.
Its only the fact that he has invented a leaving date for me thats got my goat.
I told them in writing when i was off, but that wasnt good enough for them, they had to do one better and lie about and falsify the dates on my letter of resignation.
Thats my only grevience!!!
as you say, i am happy to be out, but still dont like the injustice.
Thanks again for the support and advice.

The System & the RM machine

RM may try the vexatious and frivilous number or make your motives out to be "suspicious" though it's more a more a case of whose calling whom or at worst hypocritical and laughable especially with RM assuming the moral high ground as we all know only too well ! , traditionally RM have always been defensive , secretive , autocratic and regarding themselves above the law .

They've always worked like that especially if you do your back in . With L&C in charge , RM have simply become more arrogant & aggressive , just the worst of the old school & the corporate cultures .

It would boil down to having good prosecution on the balance of probabilities in a vexed ET case , but yes RM would fight you every inch of the way .At the end of the day they've more resources and can afford to play trench warfare .Sounds if you'd need a good David V Goliath style solictor .

I've seen this game played in another industry , it suits them to turn things into test cases and the litigation purposefully weakens the union . RM will simply say that the notice period was "waived" by "mutual consent " or just waived and it'd probably stand up as you'd be regarded as a troublesome influence -laughable though it may sound . Plan B is RM the "victim " -Plan C is twist everything round or on it's head -quell surprise !

It's just a game to them and it will be .

Another way to play it is sell your story to supermarket women's magazines via a "friend of a friend" but the journalist would have to word in a vague & ambigious manner or RM will set their solictors on the publishers .

Hi Robbie (I think you may know who I am, a hint for you my nickname begins with P... think fighting ;)
Sorry I missed you on last week. My sincere apologies for missing the chance to say a final goodbye to you. You have my support as well as lots of other peoples as well I can tell you. There is a lot of anger and disgust at the way you were treated as well. As well as great delight that action is being taken too. It would appear that you have a lot of support in here too, on this Forum. I heard earlier on today that there was a visit to your old office this morning. Not heard much else about it so I don't know what action is being taken or wether this is still an ongoing investigation.
I wonder what would happen if the 'Nationals' were to pick up on this rather nice little story. Maybe they'd love this.
I don't blame you for venting your anger in this way either. It was disgusting they way you were treated too.
Good Luck in your new job too and maybe I'll see you around.

I think from now on i will refer to any as tweedle dee and tweedle dum. This reminds me of a time i told the union rep ,in earshop of a screw, that i am seeking legal advice about the situation at work. The following day i was summoned to the office and was told that my comments was unacceptable and unwelcome, and i was not allowed to take a stance like that and to go through proper channels. In reply I told he or she (not even mention sexes) that as a british citizen it is my legal right to seek any legal advice I want. Also I asked she / he if they would write down said comments and to inform the boss of the boss that my solicitor would like a word. Needless to say I was told that this was not nessecary and any problems that i have she / he would be happy to help me in anyway shape or form. (judge that last comment as you will.)
Saying that I actually personally quite like my manager, altho i disagree with their stance and views, outside work I get along with them.
