if you win but dont accept the job back if there was any portion of blame attached to yourself you will have your award reduced by that percentage.

i was given 15% blame (which was just a token imo).

i accepted my job back but got ALL of my back pay back.

on another note if you do go to tribunal and win and accept your job back make note of your holiday entitlement owed from the date of sacking.

you will be entitled to this and no doubt they will try it on upon your first enquiring about it aftre you return.
ask to get it sorted after a few days...let the dust settle imo.

if they dont get it right greivance.....then tribunal....be aware of the 90-1 day rule again from the date of notification of return by the judge.

i nearly fell foul of this when they tried to out do me of 6 weeks of holiday.

one more question
if and when i do get my job back, how do i go about moving shift or transferring to another unit?

what did you get summary dismissed for, and was it like the same, kept you working for 4 months than when dust settled got rid?

dunno about transfering but you could ask during the settlement.

i was summary dismissed for "wilful delay".
clearly wasnt wilful

btw they tried not to pay my holiday ....the hr department and dom said if you are summary dismissed you dont get any holiday pay accrued :crazy:

they only owed me a few days as id take a week or so already and was still owed a little upto the sacking date.

make sure they havent ripped you off

mine is summary dismissed for missing point of duty and dishonesty
only reason i feel they got rid of me is because i had a major from 2010 and they saw fit to just get rid, after letting me work the busy period

getting witnesses is always a difficult thing within my work place
