Hey rain maker what did you learn from the ET. What advice can you give us to watch out for ect.

Has any body had to amend the table of allegations. If so what excuse did you use to amend the table of allegation for the hearing.

The court bundle, the solicitor for the representative (RMG) is obliged to furnish you with a new court bundle on the day of the tribunal, do not use the one they sent you a few months prior to the tribunal -- although there is the problem of then having to transfer all those sticky tabs you might have used so that you can find your page quickly.

The solicitor might try and provoke you during the questioning, at all times keep your cool, and keep it simple, the tribunal are usually sympathetic to the complainant (you) just as long as you come across as a calm and reasonable person -- if you get emotional or shouty (even though you might have just cause to feel that way) you will lose the sympathy of the tribunal.

Bring diaries, paperwork, letters, anything on paper that can be used as evidence (even if it's a bus ticket) -- you can insert fresh documents to the court bundle on the day of the hearing but you must have 4 copies of each of those docs (do 6 just to be on the safe side): one for yourself, one for the representative (RMG) and three copies for each member of the tribunal.

I mentioned earlier http://etclaims.co.uk/ and that was an invaluable source of information.

Look for 'legal precedents' for 'employment courts' or 'employment tribunals' on internet. Although I had difficulty finding a case that was similar to my own.

But as I said earlier, turn up at the employment courts at 09:30 as an observer and sit on on other tribunals.

if weightmans send you a nasty letter.

send a copy of the letter (scanned and emailed) as part of your next corespondence with them.

cc ing in the tribunal.

that way anything masty they try on with you in future they will think twice.

If you do bring extra evidence or documents other than the bundle but your tribunal gets adjourned be very carefull if you get sent a new bundle.

I put in an atos report which was then added in to the proper bundle for the new date.
Didnt think too much of it at the time but it was clearly a tactic to try and make the judge think that this report was given to me when it was made available to my manager by atos months before.

so be carefull if they change the bundle in such circumstancesand try and work out why.....if you do work out why highlight it to the judge....just incase they miss it.

rainmaker7 wrote:Hi, I did an ET myself alone against the RMG and won. I still can't believe I did. I had a lot of luck that day I reckon.

But having said that, 1 main point. Paperwork is key to everything. No matter how much the tribunal might want you to win if you don't have the evidence they can't help you.

Just one question, I didn't get the reference to 'weightman'?
Weightman's "dirty tricks" (
Also, this site is http://etclaims.co.uk/ is an excellent source of advice.

Do you have the case referenced on public record ?
