How many others have actually subimtted an ET1 rather than thought about it or threatened to?
If you have did you tell angard and if so what reaction did you get?

Not yet. I've already got one against another employer for unfair dismissal and disability discrimination. I figure if they pay in the next couple of weeks it'd never get to the tribunal. Once they pass the 4 week mark though, they get the ET1. I'm afraid that I believe the ET system still favours employers. Have you submitted a grievance to Angard. The ET's like you to have gone through internal procedures first.

Lodged the ET1 Last week, I have a date in February 2012 for a hearing at a tribunal, ACAS have appointed a conciliator in an effort to prevent this getting to court. It is my intention to get this into a court, ACAS are not needed. I am quoting illegal withholding of wages, and will be quoting the difficulties in communication with this particular employer. As for informing Angard, How?
They never answer my emails or phone calls. Hopefully a letter from the court service will shake them out of their stupor.

Royal Mail have to reply to your ET1 within a time scale. If you were also told to get your own Safety Boots and have this in writing you should be able to cite this too as this is against HSE regulations for PPE - it is the responsibility of Hirer/Agency to supply any protective equipment - this includes safety boots.
You could all be citing Break Times in breach of Work Time Regulations too. Unless Angard are excluded from Working Time Regulations they are breaking the law here. They have given us only 15 minutes for 6 hours - Work Time Regulation specify for a 6 hours shift the minimum is 20 minutes.
As RM management at some mail centres, not all, are forcing these breaks on the Angard employees we should be able to bring the RM to account on this for failing to ensure that Angard are operating within the law. According to Agency Worker Regulations the Hirer (RM) is responsible for ensuring the Agency (Angard) treats the worker (us) within the law.
I realise the main issue for most people going ET1 is failing to be paid or paid incorrectly but the more of the practices, breaching empoyment law, that RM/Angard have done the greater your prospects of winning. Also the greater the chance RM/Angard will be taken to task for breaches of employment law they have done and still are doing.

If you fill in the forms correctly there is no reason why, like myself, you should not receive a prompt reply giving you a date for a court hearing. I received mine within 4 days of applying, and before xmas.

@bobthedog. Personally I'm just interested in getting the £500 they owe me. If I'd wanted to pursue them for compensation I'd have gone down the County Court (small claims) route in the first place. Having got out before they could really f***k up my christmas (and having got a much better paid temping job since) I've not got the inclination to go through a legal procedure unless they refuse to pay for some spurious reason, in which case I'll have their guts for garters.

My ET1 is now lodged, and I have received the hearing date and venue details. I don't particularly care how you "think" it works, you are clearly wrong and ill informed.
