missing special delivery
Hi
I'd be grateful for any advice on my problem.
In early December I purchased foreign currency worth about £2000 from a reputable online company who I have used many times. It was sent by Special Delivery but it didn't arrived. Now even 4 months later the tracking still says it is "progressing through our system". I asked Royal Mail, they said they had no idea where it was and I should make an insurance claim. Then they said the sender should make the claim, so I asked them to do this at the end of December, which they did. I have called them every week since then and there has been no progress, and Royal Mail wont discuss it with me as I am not the claimant.
My question is, how can Royal Mail take this long to assess what should be an open and shut case? And, who is responsible for my refund? What if Royal Mail decline the claim?
I would threaten legal action but who do I take to court? Royal Mail or the currency company? The currency seller seems to be making me wait until Royal Mail pay them, which is looking less and less likely.

For £2000 I would take the advice of a lawyer to be honest as they have more experience in such matters.
However, I will give you my opinion - Your contract is with the online company, and therefore that's who you should deal with. To be honest I am surprised that they have not settled it with you already.
I think you'll need to research the "Distance Selling Regulations" and see if your situation is covered.
Ultimately the company will settle the matter with Royal Mail.
BTW you do know the Post Office does foreign exchange and you can collect for your local one as well, a bit more secure as well for you

As already stated by TrueBlueTerrier, this does fall under the Distance Selling Regulations.
The company has an obligation to either replace or issue a full refund, including postage and packaging, and the choice technically should be yours as you were never able to take ownership of the goods as they were never received.
It is down to the company to then press Royal Mail to either find or replace via the insurance, once again Royal Mail are bound by the same regulations however for company to company it differs, though this should not affect you in any way.
My advice before you chase it up is visit consumeractiongroup.co.uk and follow what they say in terms of presenting your argument/case to the company. Also, before you decide on replacement or a refund, you should check out which way you will benefit you under the current currency rates.

you could try claiming through your visa card with the bank give the bank a ring i think you should have rung the bank visa company sooner

Mention DSR to most companies and they will back down in a shot. You have a contract with them, it's them who has haven't fulfilled this contract.

How can you prove it was even a theft and not missing like the other millions of items? come on bringon, a loss of tracking number does not prove theft or fraud (incompetence perhaps but thats another thread).
The company has to pay the original thread starter.
Royal Mail have to pay the company.
The police have to fine drivers.
