Re: May 7th Lump sum £400 for part timers? agreement broken
what i find strange is that royal mail and the union have not tried to cover up this error, with some kind of linking parts of the agreement to the rewards table, at least then they can argue a point. i rang some community legal advice support group today and they said i wouldnt receive legal aid thus having to challenge them out of my own pocket lol, so i assume royal mail and the cwu expect to be unchallenged at least in the tribunal/employment courts. What we need is a millionaire postie who just does the job for the care of the community and wishes to challenge this biased unfair payment lol

The union has its own legal department and as a member of the CWU you can avail yourself of presumably impartial advicetragictramp wrote:what i find strange is that royal mail and the union have not tried to cover up this error, with some kind of linking parts of the agreement to the rewards table, at least then they can argue a point. i rang some community legal advice support group today and they said i wouldnt receive legal aid thus having to challenge them out of my own pocket lol, so i assume royal mail and the cwu expect to be unchallenged at least in the tribunal/employment courts. thats exactly what is needed if this was challenged in a court then i think you would find royal fail having to honour the wording and pay up but of course dingo and co seem to resent p'timers getting what the words say they should have as it was...... 'not part of the colleauge share money' ...... at least thats what they said prior to 'the democratic vote'

Lets be honest, pro rata is unfair, I've worked here over 6 years and I'm still part time, yet many others who have worked here less than me but have been fortunate to get afull time contract get more financially. Surely this can't be right.

When it's all said and done here, the bottom line is this:
RM f****d up!
CWU HQ f****d up!
Yet another fiasco so soon after all the debate about polling cards leaves me wondering.....
It is plain to see that the road ahead in "transforming" the business is going to be a long hard slog. How many words or paragraphs in the agreement are going to be twisted and manipulated to shaft us?
And thank you ACAS for demonstrating that you clearly have absolutely no interest in resolving issues as you said you would

If anyone still has the slip they put in with the ballot paper telling us to vote yes could they scan it? I'm almost certain there was no mention of pro rata on that.
Ps.and before the couple of blowhards on here tell me to stop moaning because I didn't want it and voted no,go f**k yourselfs.

Had a word with the union rep, and he agrees it was badly worded, but should have been explained fully in any meetings before the vote.
So I'm kinda feeling atm like we've won the battle, but lost the war so to speak. RM and CWU admit that their wording on page 62/63 was wrong, but as it stands, it's prorata, end of story.
Moral victory maybe, but still feel cheated

just found a letter sent to members on the cwu site with the following and signatures:
even more evidence staff were misled on the leadup to the vote!!, royal mail scum
http://www.cwu.org/assets/_files/docume ... arch_2.pdf" onclick="window.open(this.href);return false;
A reward package over the next 3 years of:
➢ A reduction in the working week of one hour (a cash alternative for some grades).
➢ Increases to basic pay
● 2.0% in April 2010
● 1.4% in April 2011
● 3.5% in April 2012
➢ Guaranteed payments of £1,000 per full time employee linked to transformation.
➢ Conversion of some existing payments into weekly and permanent non pensionable supplements
to basic pay (full details of this will follow).
➢ Improved maternity and paternity pay.
➢ As a result of this agreement colleagueshare payments in 2011 and 2012 should now be enhanced.
➢ £400 when the agreement is ratified
Pensions remains a concern and having reached this agreement the union is now making immediate representation
to the Government. It is our view that they, as the owner, must now finally face up to their responsibilities.
We will contact you again with more details on all these issues and you will receive a ballot paper in due course
Yours sincerely,
Dave Ward Billy Hayes

We just need to know if the exact wording of this type of agreement is legally binding. Morally it all seems wrong as there must be some YES voters who would have voted NO if they had known the real truth. But in the end the vote wasn't close so who knows how a court would view that. Unfortunately morally counts for nothing in law.axeman wrote:thats exactly what is needed if this was challenged in a court then i think you would find royal fail having to honour the wording and pay up but of course dingo and co seem to resent p'timers getting what the words say they should have as it was...... Incidentally many home insurance policies cover legal expenses if anyone did fancy giving RM/CWU a good kicking!
What have I done to deserve this?

the wording + what it says on your pay slip some critical errors id' like to think royal fail have made a big big error on both the items in question
clearly says for acceptance of the agreement nothing about pro-rata there methinks !!

I have been told by HR that this is going to be recalculated without any reduction for length of service less than a year. Good news for us newbies who were getting it both barrels. Will still be pro rata depending on average hours worked though. Any increase to be paid hopefully 28th May.
