A DOG which bit a postman escaped a death penalty when a court heard he has a phobia of fluorescent jackets.

But Dean Roberts, the owner of springer spaniel Floyd, was told his pet could be put down if its actions mean it appears before the courts again.

Wirral magistrates court yesterday heard the 38-year-old, of Poole Road, Egremont, took the dog into King Street post office on February 10 where, without warning, it bit postman Ed Williams, who was delivering mail.

Roberts told the court he had rescued Floyd after it was abused, getting permission to care for him from the authorities.

He said he suspected the person who ill-treated the dog may have been a workman, because he always reacted badly to anyone in an orange fluorescent jacket – which Mr Williams was wearing.

Sue Foster, prosecuting on behalf of Wirral council, said: “He told the owner his dog should be under control and the man was very apologetic, explaining he was a rescue dog and he had an issue with glowing fluorescent jackets.”

Roberts admitted not having his dog under control, but the court heard he had already complied with the terms of the dog control order by keeping Floyd on a lead and with a muzzle on at all times in public.

He was also ordered to pay £90 court costs.

And the magistrates forgot to point out that dogs are colour blind.

Most emergency/rescue workers would wear fluorescent jackets, I hope the dog doesn't attack them too.

Nearly everyone seems to wear them these days, ever our managers have them (special ones with manager printed on the back ) even though they spend most of their time in their office.

Apparently they are meant to wear them in the vehicle bays or vehicle movement areas, or when there is an incident or fire practice so that they can be easily identified, not by the coroner though.

When I lived abroad it was the custom there for most dogs to be muzzled in public,certainly the German Shepherd type of dogs and other breeds used for guarding purposes always seemed to wear a cage over their muzzles in public.In rural areas all letterboxes were on the outside of gates

I find the little muts are worse than the big dogs.

Ive always thought these hi vis jackets should be banned.

Ok in the office in dangerous areas perhaps, but out on delivery dogs definitely are sensitive to them believe me.

Ive always thought we wear them so snooping managers can see you more easily.

So let me see if I understand this correctly: The owner had complied with the Law, by keeping the dog muzzled, and on a lead in Public. Is that right?

Because if so: The Law needs to be changed NOW! Because he knew BEFORE the attack, that the Dog had a phobia of people wearing Hi-Viz. And was thought to have been abused by someone who wears them. But didn't think to keep the Dog locked in the House, or Muzzled, whenever it was in the Garden!

As far as I'm concerned, that's gross negligence! And I sincerely hope that the injured Postie sues him for everything he has now, or ever will have. Hit him in the pocket, where it'll hurt the irrisponsible b*****d!
