Recently tried the average 13 weeks angle (should be entitled to 40 hours hols) with a letter to HR. Got the company line, "While you are on annual leave you are only paid for your contracted Hours. This is the same when you are on Sick Absence."

I know the I Hour Contracts have been to IT and won. Anyone tried the 20, 24, 33 (any bloody number RM can think of) Contracts yet? Anyone got the appropriate employment legislation that might be appropriate?

Probably try CWU legal help then RM legal help, not holding my breath in either case, it might help if I've got some Legal Act to quote. All suggestions appreciated.

Cheers :wave

Working Time Regulations - start digging from there and try ACAS - The " interesting " bit is when you're not working your normal hours regularly[/b] over that 13 week period that gets averaged out .

I would hazard a guess and say that legally (and not that they won't try it on,) they are well wrong. Think about it, if a OPG is on a 40 hr week contract, does his annual leave diminish because he/she uses their A/L. I don't think so? Next head on the chopping block please! Same goes for bank holidays and sick.If somebody is leaving RM and fancies trying his/her luck, an ET might sort it out. Wouldn't bother with the CWU as they seem to have no interest in the matter.

Have you tried phoning the wages section in Sheffield? They have a file on everyone.
So keep on moving, moving, moving your feet
Keep on shuf-shuf-shuffling to this ghost dance beat
Just keep on walking down never ending streets

I think you will have to take appropriate advice as how to persue this outside the post office , keep a who , what , where , when record of all phone calls , use of the grievance procedure , conversations etc so as to back up your case . RM would not be able to twist things round and make you out to be a " troublemaker " either :hmmmm .

The union can't always sit on thing either - it's not as if it will go away . Too much politics .

Sorry to hear your still getting the runaround tragictramp :arrrghhh My advice is put it in writing, even when your DOM works in the same place! Phonecalls and conversations are fine but remember they're worth the paper they're written on. Make a record of them as adviced but back them up with a letter i.e " Reference our conversation this morning etc." Believe it or not some DOMs will lie ;liar straight to your face and say, "I don't remember discussing this..."

If you've a PC even better keep all the copies in a seperate file and put your own reference number and date on them. When RM stall, as sure as eggs are eggs, send them copies of all your previous letters along with your latest one. (If you haven't a PC ask a mate to help). Ask for problems to be dealt with by either a certain date or within say 14 days of your letter.

I'm not sure if it's a RM management technique but I have never had a written response to any letter of mine. If you're dealing with another office you might even like to send the DOM a "Special Delivery" letter :cool You'll still not get a written reply, no evidence to bring up at IT I'm sure, just a policy of Delay, Deny, Delay hoping you'll get bored and give up.

Stick at it and good luck, you never had the money so if it takes 6 months to get it you're still up on the deal. Cheers :wave

Other ways of making a manager do his/her job insteade of drinking coffee is,
1.Write a letter to your DOM out-lining what you are owed,in the letter make sure you have all the dates and times.
2.Find out who are his managers, send a copy of the letter you have sent the DOM with a covering note to explain why they have this letter to each of them,so your going up the chain of managers.
3.Send a copy to the head of HR so they get the info with a covering note, always put hopeing somebody may help you.
4.Send a copy to croziers office for him with a note saying that you have spoken to so many people your hoping he might be able to help.
Result see the s**t hit the fan we found out that he does not like his hours of work disrupted by things like this so he jumps on everybody on the way down to get it sorted, thats what we did to get 1 of the lads his money and his holiday sorted,we are just about to do the same again to get my lad sorted as the manager informed him that he was to busy to do anything and that my lad is not important they owe him shed loads of time for holiday that he was entitled to anyway,i know its alot off work but it is a pleasure to see the t**ts get a kicking from up above.

How do i go about making a grievance against my Main manager?, ive exhausted all avenues in receiving my holiday pay, 3 weeks on from his promise he will look into it, and after passing the buck around to deputy and wages guy it has now fallen back on his shoulders of responsibility, i was in his office today with the union rep, his deputy and him and he said, he does not know how to work out how to pay me and he has'nt got time to look into it, so basically he will leave on the back burner forever. On speaking to hr they advised me that he is the only person who can authorise any payment and he can ring them if he needs advice, they also told me that if he is unwilling to sort this that i should put in a grievance against him!, id rather he just paid me as im bound to get more grief if i put in a grievance against him, so he is the main dom, would i have to goto the regional or area manager?, is their a special grievance form or do i just write a letter? id ask the union guy but he just stands their saying nowt!

im fed up of em, they pxss me right off, all i want is what im entitled to and in 10 mins actual work rather than coffee drinking or smoking they can get me off their back!

cheers peeps, i feel like burning the office down lol

got to exhaust those avenues - then ! - you can take a tribunal out against them - Form IT 1 from a dole office or job centre . RM can't play the old injured innocent routine then and make you out to be a " troublemaker " .

Let the union know that you're taking RM to court regardless of whether they'll support you or not , if they aren't don't let them talk you out of it .
