As I see it, where I work.
The non legacy workers work alongside a legacy worker, starting and finishing at the same time both are working a 6 hour day. The legacy takes their break, the non legacy sits and waits, after 30 minutes they start working again, finishing together, clocking out together and both get paid 6 hours.
(I know this can be in 15+15, 20+10 etc)
Then the non legacy already gets paid for the break?
It’s not the responsibility of the legacy to send them off to do another loop.
This doesn't cut the mustard in larger offices. The non legacy worker still owes RM half an hour if they both SISO at the same time. That daily 30 minutes soon adds up.

The new start should be on their break too. The legal minimum is 20 minutes, it's just that getting paid for it isn't the law. I keep hearing this misinterpreted as new starts not due one at all.
The machine stops.

Workers are entitled to a 20 minute unpaid break during the working time, not at the beginning or end of the working time, where they work more than 6 hours.

Anyone know this?:
New entrants are not paid for their breaks. So does that mean that of they work 7 hours, they are paid for 6.30hrs?

Or, are they paid for 7 hours, but have to come in half an hour early to account for their break?

Every single new entrant in ours takes a 20 minute break alongside their van share partner. I've no idea if management claw it back somehow.

Ours were told to come in half an hour early and the reason given was that their unpaid break is not deducted but they have to take a break by law.

I imagine ours is something like that. Makes sense.

There's been numerous comments on here saying that a van pairing have different finish times which is plainly stupid

I wish there was a definitive way of working so that every new start knew what would be the system.

Ours were told this week they must clock out 20 mins after the legacy contract staff, even if it means just sitting around for 20 mins!!

Ludicrous.

They are entitled to an unpaid 20 minute break but they can’t be forced to take one.

They could work their 6 hour shift and not take one.

This has been answered on another thread ( the legal part of it )

We overcame this by coming in 20min early, that was only way we could leave same time..

Ours have been told that they can’t NOT take the break because they gave to take a break by law.
