depends when you go tthe job as well. If it was before the Discrimination Act came into force I dont think it counts, but as someone else has stated if jobs are picked on the basis of age NOW..it is dicriminatory. Seniority isnt based on age as there are younger people more senior than me and I too, am senior that some older people.

How do you know it was because he was older? Perhaps he was the better candidate.drevil1969uk wrote:im a part timer and a full time job came up. This is illegal under a newish labour law, Therefore how can seniority still be valid in such circumstances. Rather than by how good they could do the job it was given to someone based on there age.
I have an idea of a way to solve it one is an idea thats probably hardly to manage but fairer. Stagger employing people and make them start at the bottom and as things are at the moment pick the best candidate for each job

SENIORITY
When I started I got the crap duties and holidays--I accepted it.
I knew I had to wait a few years to get better pickings.
Now I have done twenty four years I want my share!
Seniority is the fairest of all-----obviously the least senior amongst us are the ones who complain---human nature!
You take the mess up with leave these days never had trouble when seniority was in, seem to have more conflict now than we ever did.

I'm afraid our office is bad for allowing duties to be picked up by new entrants and being left on them - - I've complained about it even though it doesn't affect me I can't get them to give me a work-plan/318 - so I just do what I like for the most part. One duty has been split in to 3 because it is a large development and a woman has been doing 9 til 2 Mon to Fri for the best part of 12 months without that part of the duty being put up as a vacancy. Not that I want to do it but there are plenty of part timers who would jump at the chance.
