And the current change ballot can be used to strike until 17th Feb
Yep just in time so the postal backlog will be cleared and this dispute is not about backlogs but a change in attitudes of the employer we will keep on fighting forever. Even if we get over the line another hurdle will be placed before us and it is an ongoing struggle for our rights not just as postal workers but as citizens of the nation and the world!
Backlog, what backlog? I had a mobile SIM card come in 2 days, just ordinary 1st class, not tracked. Office not as busy as normal early December. I'd say between those working overtime and days off and the agency, the strikes have made bugger all difference.

I guess you're not from the North West then or just talking bullshit?
Not from the North West, and just telling it how it is.

Now the insults start as cannot argue against referenced legislation, so predictable.

Now what did I say about it being a matter of trust?

You might not care about your financial security, many others do.

After 12 weeks, you can be dismissed if you take industrial action and your employer has tried to settle the dispute. For example, your employer may bring in advisers from Acas to help find a solution.
Well talking takes two and that is binding arbitration not there yet and it would have to be sanctioned by the government and they are very coy about this. And the result will be somewhere in the middle not this is our Final offer and f**k you all deal that some tossers on here espouse!
Jesus wept more personal abuse on here ""tossers"" just because some people have a different opinion makes them ""tossers""??

You can't argue with this guy! As soon as you disagree or offer a different point of view, he tells you how wrong you are or that you're insulting him. I'm getting very tired of the same lines and rhetoric in pretty much all of his posts.

The kindest word I can find is unreasonable. It's not the word I'd prefer to use but in the interests of not outright offending him I'll play by the rules of rmc.
just put the twat on your foe list ! its bliss hes a total w****r
Life would be boring without conflict and he/she has issues with us as we are the union but everyone has an opinion just like everyone has an arsehole every online community has one and the same is true.

Now where in the mediation process with ACAS does it state Binding Arbitration is a condition of a reballot under the TULRCA 1992?

ACAS has no statutory powes to impose such terms

Now are the CWU going to answer the question members really want an answer as we are talking a two week deadline rather than playing Russian Roulette with their jobs?
Just posted you a link read it because we are right and you don't know what your doing causing a stir on here is tantamount to treason in our book. The whole process was talks with mediation like marriage guidance it is a facilitator of reconciliation and a meeting of minds that is ACAS none of which precludes or stops us from the protest of withdrawing our labour. Nor indeed will it result in mass sackings or redundancies of staff as to your stance we are playing russian roulette is nonsense we all had a vote is laughable at best.
Been convinced for a long time Redlen is a manager s**t stirring.

Who said anything about dismissal?

But since you asked the question?

Nothing stopping Royal Mail dismissing striking workers without legal protections in place once the disciplinary procedure has been followed. Which can take many months.

Nothing stopping Royal Mail then dismissing you and rehire on inferior contracts.

Not saying that is gong to happen, but a very real possibility and an easy way out for Thompson to slim the workforce with no redundancy compensation.
Ok I take your point re dismissal.

So the possible senario is that say 100,000 strike on 23rd. RM could theoretically suspend all those who took that action without pay given the seriousness of the breach of contract. RM then have to find agency enmasse to cover the areas of the operation i.e M/C, distribution, Delivery etc. How practical is that? :hmmmm

Alternatively, why don't you put posters, whose reasonable views offend you, on ignore then you won't have to see their posts.

From what I have seen, people on this forum are being remarkably restrained in their comments about strikebreakers and supporters of a surrender deal.

Who said anything about suspending the employees?

You can still do your duty during a disciplinary as suspension is optional.

This is a question that I was trying to find a definitive answer on.

All, there have been lots of questions in relation to the below clause which has been shared numerous times regarding being dismissed for industrial action.

To be crystal clear, the first strike on the CHANGE ballot took place on 30th September 2022, meaning that 12 weeks from that date is 23rd December 2022. However it is not as straightforward as just a 12 week period as this is also dependent upon discussions/talks and attempts to resolve the dispute during this period taking place.

As such all action up and until the date of 23rd December is against the change ballot meaning nobody can be dismissed and legal advice will be sought to clarify the status of any action after 23rd December with more communications being issued.

I may have missed the communication but I don’t recall seeing one.

Exactly my point

The PEC have acknowledged and known of this issue for weeks yet remain silent.

Hardly scaremongering of misinformation

You need to ask yourself, why?

The only thing expiring is some peoples resolve in some peoples nay saying on here the fact of the matter is it was not binding aberration but overseen as a dispute management process. All the ballots are still live and we are good to go and win this dispute this year!

And where does it state in the TULRCA 1992 that ACAS arbitration has to be binding to cancel the 12 week statutory obligation?

If you are going to make such statments AND SAY THEY ARE FACTS, kindly gIve an objective second reference source rather than personal opinions?

IT IS NOT binding can you not read we used them as a mediator not as a resolution so ACAS is as much use as your next door neighbour giving you sex tips you can try it but it will not make you any better in bed!
