Niow this is the problem, it is all about trust.

Why are the CWU representatives being deliverately evasive?



Any industrial action that is in breach of TULRCA 1992 will not be protected, and will be unlawful. Unprotected industrial action can be action endorsed by a trade union, in which some members of that union are taking part, or unofficial industrial action.

Now the insults start as cannot argue against referenced legislation, so predictable.

Now what did I say about it being a matter of trust?

You might not care about your financial security, many others do.

After 12 weeks, you can be dismissed if you take industrial action and your employer has tried to settle the dispute. For example, your employer may bring in advisers from Acas to help find a solution.

Well you need to care as the law treats everyone with equal contempt.

Royal Mail will use every injunction opportunity at its disposal exploiting anti trade union legislation.

Well talking takes two and that is binding arbitration not there yet and it would have to be sanctioned by the government and they are very coy about this. And the result will be somewhere in the middle not this is our Final offer and f**k you all deal that some tossers on here espouse!

So you think the union & the union lawyers are completely unaware of this said fact? Have you emailed/tried to contact Dave or Andy to alarm them of this vital point?

It colleagues are dismissed enmasse from 23rd, the union, colleagues etc are going to be saying something about it & taking action! The likelihood would be the collaspe of RM, they ain't gonna be finding 100,000 agency staff in a hurry :hmmmm

But since you asked the question?

Nothing stopping Royal Mail dismissing striking workers without legal protections in place once the disciplinary procedure has been followed. Which can take many months.

Nothing stopping Royal Mail then dismissing you and rehire on inferior contracts.

Not saying that is gong to happen, but a very real possibility and an easy way out for Thompson to slim the workforce with no redundancy compensation.

This ^^^ is not doubted, it's the law. But IMHO even if a ballot had been held before 23rd Dec (hypothetically) or with the new ballot
to be held Jan/Feb 23 I don't believe the clock for the protection from dismissal will be re-started with a new vote for
strike action - because it's a continuation of existing IA.

If there's something written down that says the protection will be reinstated every time there's a new ballot I'd be interested
to see it, as unions would make it a standard practice to revote every 12 weeks after ACAS/attempts at resolution are made.

Sorry to say it but after 23rd Dec in theory the protections probably won't be there if tested in an ET but I don't think RM
are that stupid to arbitrarily start dismissing people before Christmas.

Without doubt though the laws/regulations are not 'worker' friendly!

Rather than insults, how about a reasoned argument if you disagree with statutory legislation?

The PEC were advised of this weeks ago yet still remain silent.

You can't argue with this guy! As soon as you disagree or offer a different point of view, he tells you how wrong you are or that you're insulting him. I'm getting very tired of the same lines and rhetoric in pretty much all of his posts.

The kindest word I can find is unreasonable. It's not the word I'd prefer to use but in the interests of not outright offending him I'll play by the rules of rmc.
