Asked a fairly simple question and get abused for it
I'm being asked to forfeit a days wage to support this colleague so I think I have every right to ask questions about it

The thing was it wasn't a simple question - you yourself said "Led to believe" that's a statement, not a question.

He wasn't abusing you - he asked a simple question about what you wanted to achieve - hopefully, you achieved the fact that its miscommunication from your rep who put 2+2 together and made 5. Dave's own MP made a statement
substantially less than Mr Mitchell’s potential earnings if he worked until retirement
He is right about the fact the someone is saying he is going for 10years pay is "made up s**t"

TBF to the boy Todd, I was at the same gate meeting and it was stated that in the RM propaganda piece that they have again said they will not reinstate Mr. Mitchell. So if they maintain that stance, then perhaps the only thing that would be acceptable to Mr. Mitchell would be the remainder of his salary for remaining years of service. This was perhaps an assumption that someone has made further up the chain of command and has worked its way down to our rep, who may I add is doing a great job and I trust 100% not to have been making stuff up and only passing on what he has been told.

I think perhaps some have interpreted that as the "10 years wages" being the ultimate aim. Clearly getting his job back is the ultimate aim, but we have to be realistic and understand that might not be achievable, therefore what would be the next best thing for Mr. Mitchell.

I think what really needs to be said is that this is a fight that we cannot afford not to have. If RM are given any sniff of weakness from our membership, then its all over. Cases like Mr. Mitchell's will become common place. It isn't an easy thing, potentially losing money, which most of us can ill afford. But losing a days wage is a damn sight better than in the future being faced with the possibility of losing a +£20k per year job, with no evidence of any misconduct.

I totally agree. However, Royal Mail are not legally bound to reinstate him, therefore it has to be considered what would the aim be should they not change their stance?

Would it make you feel better if I came on and said "We will get Mr. Mitchell his job back, 100% certainty"? The only thing that would give that 100% certainty would be a change in employment legislation and/ or government intervention (which is perhaps doubtful now we are a fully privatized business)

Just because I say that the ultimate aim MAY not be achievable is not a sign of me throwing up the white flag. Far from it.

I hear what you are saying and I totally agree. none the less, as I said it sends a shiver down my spine. the thought they can get away with this. they have always had arrogant managers. but hells bells, to conspire like this to get their own way. and ruin a blokes life because of it.

Aye it is horrendous. Which is why this fight is so important. So that they are left with no uncertainty - we will stand together and fight you, when you try to carry our something as unjust on this magnitude.

I don't know Mr. Mitchell. I don't even know all the details of his case. But I do know that when my union call me to arms, I am going to answer that call. Otherwise, what is the point of being part of a union?

I am the rep in question here and was asked by staff what happens if Mr mitchell did nt get his job back what would we be looking for ,my assumption is that if he cannot get his job back then we fought to get greater compensation to him for this mess royal mail have created , for me this fight is also about the future for all of us ,sorry if this has been confused by what I said and my vote is in and hope everyone votes same as me .

Royal Mail management are abusing the tribunal system.
They believe that the tribunal gave them the option of reinstatement or extra compensation but that is not how a judgment works, the decision was to reinstate David but because a tribunal cannot force a company to reinstate they have a penalty system in the shape of extra compensation, these penalties are supposed to deter companies from ignoring judgements.

Royal Mail has deep pockets and would rather pay a penalty than treat its staff fairly.
The question is are we going to sit back and accept that?, If we are then your contracts are worthless, the attendance procedure is worthless, the conduct code is worthless, every single thing we've fought for and lost money fighting for is worthless.

Don't do this for anyone else, look after number one, vote yes to protect yourself.

Could nt agree more we need to stand tall and fight, everyone fearing for jobs if they go on strike but I also fear for our jobs if we dont ,united we must stand to show our strength

the next time RM try to get an injunction to stop us from striking, can we not just do what they did and ignore the court ruling to say we cant strike?...and just go out on strike anyway and not give them or the court a second though. see how they like it.

so how can the court not do more to royal mail for not doing as instructed if they can do it to us. RM are exempt from courts orders but we aren't?

An employment tribunal is a small court with limited powers where as the high court has massive powers like human rights and it is this court which all major decisions are made. Not saying it is not major to David Mitchell but that is the scales of justice being weighted in the favour of the rich and powerful and corrupt corporation's and individuals of this land.

Rumours are toxic. Dave Mitchell has around ten years to work so reinstatement has to be the only solution. Don't spread rumours that can only do harm to this innocent man
