Hi all

As anyone got anymore info on what's happening with this issue?

Thanks

Is there an update to this yet? Will this be included for ex employees or just current cwu staff?

Might have to wait till it's in the daily mirror, that's where the cwu usually get their info from.

It's good to get these types of threads, the ridiculous my manager said bollox, so we can reassure ourselves that while the world is falling apart, Royal Mail managers are still being the low-life C***S they have always been.

Notes to editors:
1.The judge in the recent UK Employment Appeal Tribunal case of Bear Scotland versus Fulton ruled that holiday pay should include non-guaranteed overtime.
2.Non-guaranteed overtime means overtime that employers are not obliged to offer but a worker has to work if it is offered.

I don't see how this case can apply.
Nobody has to work overtime. It is optional and we already have a system in place for SA overtime being paid on holiday.

but our contract does say overtime is expected to be performed, but they have never enforced it to any degree. It may be a loophole that the CWU are looking to explore.

They (RM) have always said that, but it's unenforceable in reality.
Maybe employees believed it back in the 1970s, but now there's so many rules (largely in the employees favour) that to try and force anyone to do O/T would be a legal minefield.

Contractual overtime is quite common, BT has it during bad weather but it has to be very detailed in your contract not a couple woolly lines like ours.

I do contractual O/T on Sundays but it's not on any detailed contract. If you agree to work these attendance hours on this rota then clearly you agree to work the Sundays required as well.
Ad hoc O/T is the issue here and no-one can be forced to work that no matter what some panicking manager may say.

Agreed,
We will probably end up with a settlement from Royal Mail, £50 pro rata or some rubbish which will be accepted.
