Wal-Mart, the US owner of Asda, has filed a £600,000 high court legal claim against the British supermarket chain's former chief executive Allan Leighton to try to recover what it believes is an overpayment made in relation to stock options exercised when he quit the group six years ago.
The claim, which has yet to be formally acknowledged by Mr Leighton, comes after more than five years of fractious legal letters between the world's largest retailer and its former European boss.
In 1999, as Asda chief executive, Mr Leighton played a central role in negotiations that led to a £6.7bn Wal-Mart takeover. He stayed with the US firm for a year before departing. At the time, he said he had quit for "a lifestyle change".
The dispute relates to Mr Leighton's tax liability on share options exercised in 2000. Owing to an administrative error Wal-Mart did not realise it was responsible for paying the tax to UK Revenue & Customs on Mr Leighton's behalf. Instead, it made a gross stock options payout, without tax deduction.
Some months later Revenue & Customs pointed out the error to Wal-Mart, and the supermarket group admitted its mistake, paying it £600,000. The company then contacted Mr Leighton to request any overpayment be returned. But the issue has not been resolved.
Mr Leighton, now chairman of Royal Mail and Bhs, is understood to be insisting his relevant tax bill has been settled. He said: "Having received from Asda's lawyers in the last few days information we requested from them the matter is now being considered by my lawyers to see what scope there is to resolve this."

I stiff term in jail should "resolve this"!

£600.000 tax bill, what the hell were the shares worth?
So keep on moving, moving, moving your feet
Keep on shuf-shuf-shuffling to this ghost dance beat
Just keep on walking down never ending streets

I do hope no one is suggesting that Allan is anything other than an uppright ,god fearing concientious soul who's moral standards are second to none. Failing that ,any overpayment could be made at the statutory agreed rate ,so it should be paid off in about two weeks

Sounds familiar. Didn't the Inland Revenue have to take him to the High Court to get its money when he was at Leeds United?

The thing that realy pisses me off is if we owe a few grand to the taxman they will take your house away after charging interest but somehow i dont think he will be treated the same. He will get a knighthood for all the cash he is stealing from us and the public to give to Brown and the city.

:evil/mad
Look it's a perfectly fair system , if you retained the services of the same lawyers and accountants as Allan you would get your tax code increased too
