Holiday pay for overtime - Not been paid....
Been in the job since October 2020 as agency with the promise of a contract, which finally materialised 3 months back in March 2022
I'm on a 24hr contract but do a 30hr week as standard (5x 6hr days).... plus I do probably 10-12hrs overtime through the week plus I work every Sunday so I'm working anywhere around 45-50hrs a week (haven't worked out the average)
Got back from holiday a couple of weeks back and only got paid my basic 24hrs. Brought it to managers attention and she told me that there is a system in place that pays out every 6 months on holiday pay for overtime and it was due shortly.
Anyways, couple of weeks back everyone got paid out for it.... apart from me and another lad who started at same time as me.
Turns out you need to work 8hrs overtime every month for the 6 months to qualify for a payout.
I've queried it with the manager and the union rep in my office and they've said something along the lines of this is what the union agreed to etc.... and I've obviously missed out as don't qualify.
I'm not in the union (not yet anyways), there is nothing mentioned in my contract about having to qualify for holiday pay for overtime...
I've never heard of anything like this in my life. Holiday pay for overtime has always been done on an average of your hours worked over a set period and paid out to you when you take you annual leave....
I'm still in 6 month probation, so don't want to rock the boat too much but at the same time, I want my holiday pay for my overtime I've worked which I'm legally required to get.
Where do I go with his next please?

you only need to fail one month in any of the 6 qualifying months to fail. i had over 250 hours over time in on the last qualifying period but i only had 7hrs 50 mins in on the February, so those 10 minutes short wiped out the whole 6 months qualifying period. Sundays do not count as its paid as ''skeddy''

Surely this isn't legal though? No matter what agreements in place with union etc... holiday pay is a legal requirement and must be paid out even for overtime?
What's the difference for scheduled overtime? We have the option to work the Sunday and I work pretty much all of them,. but again never got any holiday pay for that either?

As my post above says though, surely they can't withhold holiday pay for overtime, the law states otherwise, so I'm just trying to figure out why they are getting away with it?

Nobody is entirely happy with it.
You can submit a claim through an industrial tribunal but obviously you're talking about a relatively small sum and obviously you'll have to do the heavy work yourself.
There are many threads on here full of colourful language about this agreement.
Apparently it is legally sound if not morally.

Not from the D.Os they dont. All our drivers are paid on skeddy. A lad was not paid his 6 monthly holiday paymenrt and he queried it as his sundays took him over the required amount, he emailed the pay people and was told exactly that. Sundays for D.O drivers doing Sunday packets is paid at £14.35 an hour scheduled attendance. If it's scheduled you'll get it back through the scheduled attendance agreement payments.
They must have known beforehand it was scheduled because you have to sign up for that.
Obviously you can't get paid twice for it.

They knew it was scheduled rate of pay, but didnt know that it didnt qualify them for the holiday pay. Hence the reason for his email. It's a s**t agreement, and what makes this worse is that we didn't vote on it, branch did and they took the carrot and left us high and dry. Pullinger & Ward want strung up for this. There are people in my office who have missed out because they took 3 weeks annual leave, so by taking your entitled leave you miss out on getting holiday pay. You can't make this up. It stinks to high heaven, and our union leaders are happy with it the f***ing tossers that they are.

I missed on the 6 months, February I missed out by a couple of hours. I was on holiday in February,also took the Saturday before and Monday after off so short month. The rest of the months I worked well over 8 hours. Joke
