Dog Owner Has To Pay 40,000€ In Damages

The owner of a dog which attacked a postwoman, causing her to break her leg in 2 places and leaving her partially disabled, has been ordered to pay damages of 40,193€. The court in Elche declared that the dog’s owner was culpable due to negligence and also fined her 90€.

The incident occurred in March 2006 when the postie was on her rounds and stopped to make a delivery. As she dismounted her scooter, the owner of a nearby house arrived in her car and opened the gate to the house with a remote control. As the gate opened the house owners’ German Shepherd dog rushed out into the road and charged headlong towards the postwoman, causing her to fall from the scooter and consequently break her leg.

She was unable to work for 265 days, of which 41 were spent recuperating in hospital and she suffered severely form post traumatic stress and associated nervous disorders. She has been medically declared partially disabled for her habitual employment.

Perhaps this case will also serve as a warning to all those dog owners who seem to think that here in Spain they do not need to control their dogs and can be seen wandering along while their leash-less animals rush across the roads creating havoc.
