Couple of the guys in our DO use the old, 'if I was to sit and have a break I'd never get going again' bullshit! ;liar

Literally giving royal mail free time coming in early plus not taking their breaks EVERY single day! It beggars belief!

Bollox to coming in early and working for free, but what i will say is, if you dont take your break then make sure you dont go back before your time and book it on the back of the duty.

We told can only book 20 mins outdoor break if you go to time and not taken.
Basically the 20 min indoor break is use it or lose it!

Seems to be one of those things which comes down to local agreements. Read on here of people taking it at the end of their duty or splitting it into 2 breaks of 20 minutes or taking it whilst out on delivery. At our office none of that is an option, you have to take your 40 minutes at a set time before leaving the office to go out on delivery.

Nobody in our whole office takes ANY break on a saturday so thats their argument 'panned' if you like cos the gaffers are nearly always gone when you get back on a saturday. We are due to walk out the office at 13.20 on a saturday and your 40 mins break takes you to your finishing time of 14.00. So yes....its entirely a "local" thing.

lets just say you came back on your time EVERY day. but you only had a pie and a bottle of fanta at your frame for your so called break. you will be totally entitled to book 40 mins a day on your return to the office. so 3hrs 20mins overtime for finishing on your time. 40 quid overtime so about 25 quid in your hand. but if you came back OVER your finishing time, then that is added to the time you already have giving you even more.
I must be stupid because i still cant see how this is cooking the books.

No overtime being agreed in a lot of units right now, take it out, bring it back. Don't have to clear all the mail on a daily basis, so the overtime is kept to an absolute minimum. The break issue only ever comes up when overtime is involved, managers don't care when you take it as long as you aren't claiming.

There's a massive difference between illegal and unlawful.
Something has to be specifically banned by law to be illegal, taking all of your break at the end is not specifically banned.

It may be unlawful because it goes against a particular law or convention but that would be a civil case and require a complainant and an industrial tribunal.

Who would that complainant be?

As I see it if you work through your break you should get paid for that time. Our book room always asks if you've had one, if you say no they add 40 minutes to your overtime. That's not "taking your break at the end of the duty" because for all they know the break you worked through was between 10 and 10.40, or any other arbitrary 40 minute window.

Also, a lot of people come back 40 minutes before finish time where I am, and it's not frowned upon. I mean, we do finish at lunch time if we do that....
