I have a long-running Grievance Procedure since last August.
)It’s complicated!

Yesterday, RM emailed me to say that at least one of those interviewed had demanded ‘as is their right’ to know the identity of the complainant.

This woukd be disastrous for me and I would feel very unsafe, both at work and at home. (There’s LOTS I’d people being interviewed.)

Do I have to agree or do I have to withdraw my Grievance.

I don't know the in and outs of grievancy processess but aren't you in the CWU? Speak to a rep about it or try ACAS for advice.

My CWU Rep is away’ for a while snd steps down on 6 Feb.

The incoming Rep has stated to other OPGs that:

1 he doesn’t intend to ruffle the feathers of Management.
2 he doesn’t see why he shoujd put himself out for Angard CWU Members
3 babe rather that Angard staff were precluded from CWU membership

As regards ACAS, I intend to ring them on Monday. TgNjs for the suggestion.

Seek Legal Advice as I am not up on the law but..... link above:
The Acas code of practice on disciplinary and grievance procedures, which is taken into account in relevant tribunal proceedings, states that it would normally be appropriate to provide the employee with copies of any written evidence with the notification of the disciplinary hearing. The non-statutory guide that accompanies the code states that the employer should give copies of any meeting records to the employee, but states that protecting a witness is an example of a circumstance in which withholding information may be appropriate.

RM Investigation & solicitors have agreed that the Grievsnce can now proceed, with full anonymity, due to the nature of the complaint and the extent Of it.

There is the caveat tgat it might have a bearing on the eventual outcome.

Better that than risk revenge attacks.

First step ask your Unit Rep. If no joy there ask the Manager (sounds daft I know, but if he refuses it make's it look worse). There is a copy of it on his Laptop so he's only got to print one off. :thumbup

Once you've got a copy I'd suggest you make a few copies and keep them for possible future use. Our Rep has a stock of them and everytime someone starts gobbing off about something he just gives them a copy and says, "There you go fill in a Grievance form and hand it in" Guess what ? ... half the Gobshites don't bother they just like to moan. :cuppa

A serious accusation was made against me,,i wasn't aware of the greivance nor the complainent..how can i defend myself if i dont know who brought the charges or what they were..case dismissed

I had this a while ago.

You do NOT have to authorise the release of your name.

However, in my experience, the Grievance will peter out.

It’s a tough call. I felt the same as you. Lots of Managers were interviewed but they all denied everything, stuck together and they are still in place, up to their old tricks.

It was very dispiriting but I would not have felt safe if my name had been released
