They had no idea of the incoming claims from people who have just been shafted-in fact I could hear an audible groan when I told her.
She was definitely aware of the general unrest, and people having withdrawn claims that haven't yet been paid.
At least for those of us taking it the whole way, we have light at the end of the tunnel now, with cases set to be heard around April next year.
Thompsons are representing 2 Claimants who will have similar arguments. The outstanding CWU posties, the Thompsons 2 and the unrepresented will almost certainly be lumped together with any new claims for the hearing in April (well a sample 10 of them).

The more who put in new claims now, especially those who withdrew without realising the effect of the 8hr rule, the better chance of the 8hr “annoying’ policy being kicked out and holiday pay being paid as it should. Hopefully the huge number of moans will turn into claims and not apathy.

After the payment on Nov 26th to cover Period 5 (Apr 21 - Sep 21) I take it any overtime done now will be adjusted automatically on payroll for Average Holiday pay, and it won't require the 8hrs per month criteria to qualify?

The 8hr criteria is the deal going forward.

Unless RM change it voluntarily, it will only be changed if enough people put in claims and the Employment Tribunal rule otherwise.

Correct.
I was told today that anyone that didnt put a claim in, or withdrew their claim, will likely not be able to claim retrospectively, as they knew the terms of the deal before accepting the money.
Which tbh seems fair-you can't have your cake and eat it.
Although this has yet to be tested.
The current claim will be a whole new ball game as it is going to paid to everyone regardless of whether they accept the deal or not.
The whole situation is a complete mess.
