Disability
Discrimination
Act

It's supposed to give you Legal protection from discrimination based on your disability, and to ensure that you aren't denied access to treatment because of your work commitments.

It doesn't just cover physical disabilities, but also mental disabilities (e.g. Depression). But you need to have been affected long term, or have a permanent disability to qualify. RM however, think that they can decide who is covered for themselves.

I was threatened with B&H proceedings, for consulting a Lawyer to find out the truth about the DDA. The manager accused me of trying to intimidate him with Lawyers!

Had the ATOS telephone consultation today, sounds like ATOS may be coming to there senses, was told to go back to my Drs on Monday and get signed off for another 2 weeks (don't know if the Dr will do that on ATOS recommendation) and then on to light duties for 4-6 weeks, thats going to go down well with management :cuppa
So keep on moving, moving, moving your feet

:funneh :funneh :funneh - they don't like it up them as Corporal Jones used to say -is that a stock retort now ?

I've had that in a ex state industry -" Are you trying to blackmail us ? -this proves your hostility " -on a "Poor " performance review for that , I'd to get the Branch Secretary in .

I'd call it calling their bluff & assertiveness , you've a duty /responsibility to do that

People who listen through doors hear worst of themselves . I put the AM in the Union paper along the latter mentioned one & his sidekick . I'd him staring at me , job was always done to the book and it wouldn't do to throw stones in the glasshouse if he wanted to make a issue of things .

Let a ET decide who is covered by DDA , not planet Royal Mail

I'm back at work now, the LM has'nt shown me the ATOS report yet, was told this morning I'm back on normal duties as they said they could'nt find anyone to cover my duty. I hope I get to see the report tomorrow as I'm sure the ATOS nurse recommended going back on reduced hours and definately insisted on light duties. I've informed my rep, so we shall see what tomorrow brings.

If they can't staff the office properly, that's their problem.

Don't let them bully you into doing too much, too soon.

If RM want to treat ATOS like gods, then they have to accepts ATOS reccomendations for your return to work. Ask to see the report from ATOS before agreeing to anything.

If anything in the report is not what you agreed with ATOS nurse, then tell your DOM and your Rep. Contact the person you saw at ATOS and tell them that the report is in error and you want it amended. Tell ATOS to contact you DOM immediately to rectify the situation.

If they still f**k you about, demand another interview with ATOS asap.

Remember, if your DOM forces you to do a full duty, point out to him you may have a relapse because of him ignoring ATOS and medical advice, causing you to be off sick again, maybe even longer than you were originally.

Whatever you do, make sure you have a witness present when discussing it with your DOM, and make sure keep a note of dates, times and what was said to you, for future reference. You never know when you might need to put in a grievance against your DOM or ATOS.

the nurse doesn't sound that bad , it's common knowledge that most of them think some Doctors are arrogant ****holes .Probably ex -NHS and would know who the hypochrondriacs , scivvers, old soldiers and malingerers are , unlike RM & don't give a A TOSS origin.

You must demand to see the ATOS report. It is up to RM to accommodate your circumstances not you theirs. If they can't find someone to cover your duty then that isn't your problem. I don't wish to be a Jeremiah but let's just say you were involved in a traffic accident and was confined to bed with a broken femur for some weeks - would they expect you to show up in a wheelchair? Of course not, they'd find someone or instruct someone to cover the duty.

Daft as it sounds (and is!), you have to ask during the consultation, if you want to see a copy of the ATOS report! If you don't, you won't get a copy at all. only the Manager who requested the appointment will see it.

Hi there all

I have been through the RM touchy, feely, carey, carey health regime, NOT !!!

My DOM was very caring, considerate and respectful of the issues that kept me from working. The area manager and his sidekick secretary (NAZI's) however were not. I faced nothing but a bunch of lying, manipulating, intimidating, nasty two people I could have ever imagined dealing with.

The first thing to ask any ATOSSSSS tosser is "ARE YOU A DOCTOR, OR ARE YOU MEDICALLY QUALIFIED". The answer invariably will almost always be NO. They are basically qualified in OCCUPATIONAL HEALTH. This means absolutely nothing. They are just hacks. Take as much medical evidence with you. Doctors reports, X-Rays, MRI scans and CAT scans and ask them to look at them. SURPRISE, SURPRISE, your very friendly ATOSSSER will refuse to look at it. Why ? Because they don’t understand medical evidence that’s being presented to them. They will refuse point blank. When it comes to a tribunal they could not stand in a court of law and give evidence.

Before you even get in the room Royal Mail have already given ATOS an agenda. Always take a witness with you. The ATOSSERS never expect this and are very careful what they say in the presence of company. I have been in an interview with their nurses and doctors with a witness and without. Two very different experiences. These people are just a line of intimidation to get you back to work. Great if your swinging the lead, but a very nasty experience when you’re genuine. Genuine or not, neither RM or their hench persons give a crap.

Every time you visit ATOS, get the report from your manager. By law they are duty bound to give you a copy. Don’t take any of their crap. They have to give it to you. If they are being awkward, just explain that ACAS have advised you to get a copy. All of a sudden MR DOM will crap himself because he doesn’t understand anything other than what the RM intimidation machine is telling him.

These are just my experiences with RM. I had no intention of ever believing anything they told me. I verifeid everything with ACAS, a free service. All it costs is a phone call. They are a law to themselves. They prey on you when most vulnerable.

I hope this helps.

Yes, that's right, they do. They will tell you that it will delay things, because they have to send you a copy before sending it to the manager. But don't worry, you can't be held responsible for any delays, as you have the RIGHT to see any reports that they write about you.

I made the mistake of not asking for one, and it caused no end of trouble. But any time this happens again, I WILL be requesting a copy. It saves so much BS, as you know in advance what the ATOS fools have written about you. That gives you the time to collect the neccessary medical evidence to prove them wrong.

Don't forget: ATOS is there to back up RMs attempts to get you back to work BEFORE you are well enough.

Especially if its on a computer anywhere as you are allowed to see almost anything on almost any computer under the Data Protection Act 1998

The Act, with some exceptions, gives you the right to find out what information is held about you by organisations. This is known as the 'right of subject access'. On written request, you are entitled to be supplied with a copy of all the information an organisations holds about you.

The organisation may charge a fee for providing the information, up to a maximum of £10 in most instances and up to £50 in the case of manual (i.e. non-electronic) medical records. To see what information is held on you by credit reference agencies costs £2.
