Confused By The Agreement

Post by SW Postie »

It’s probably me being daft but could someone explain in the simplest terms how the agreement works please?

I now work in an Airport Hub but previously was working on delivery. On delivery I was on a 35 hour contract and always performed regular overtime. In the 2019/20 year I did an average of 11 hours OT per week and in 2020/21 I did an average of 8 hours OT per week. Holidays were paid at 35 hours per week. Should I expect some kind of back payment and if so how would it work out?

Thanks in advance for any replies. 👍🏻

Anyone know what dates we are looking at that the back pay will be worked out from?
I have read the LTB's but can't see a reference date.

Back Pay
It is agreed that back pay for historic regular overtime worked will be backdated for a
period of two years from April 2021. This covers four separate 6 monthly qualifying
periods made up of Periods which will broadly encompass the following months:
a. April 2019 to September 2019
b. October 2019 to March 2020
c. April 2020 to September 2020; and
d. October 2020 to March 2021.

sorry, probs being more dumb than hopefull

Can you just confirm something?

do you have to work 8hrs per month in each of thee 6 qualifying months or do you need to work an average of 8hrs across the 6 qualifying months, ie 48hrs across the six?

it seems that if its the 8hrs each of the six months, then theres nothing to stop a manager stopping your overtime for a month maybe feb or march or april and maybe aug or sep or Oct, so you wouldnt ever qualify for a payment?

My manager stopped my overtime in April, i did ot every week for previous 10 months and ot most weeks/months before that and have done ot every week since but now worried will not qualify for 3 weeks of al over the summer?

in which case should have been 6 months out of nine to negate this, hope i got it wrong...

Thanks for clarifying.

So the next 6 monthly qualifying period is from 1st April 2021 to 30th September 2021?
Presumably (and assuming this all gets passed through local/national ballots), (and also the backpay has already been received/an individual sees through this agreement and tells RM to go to hell and pursues it himself with ACAS), we will get a payment around the beginning of October 2021 for the previous 6 months average, and then a payment every 6 months after that?
I have read the attachment and this doesn't seem clear unless I'm missing something.
And as Sardonicus points out above, the stopping of someone's overtime from April this year is extremely disingenuous and would certainly result in hardship for that individual.
Not to mention an unhappy coincidence it happened on the date of the start of the next 6 month qualifying period, (assuming my interpretation as above is correct), even though the agreement has just been reached, and that manager wouldn't have known in April. Or did he?...

That's interesting, I'm on the new 35hr full time contract and we're close to the new reduction to 37 hrs full time week, so if I don't incur any overtime over my 2hrs per week for 35 to 37 then I'll never get the extra holiday pay as I won't do 8 hrs every month in a 6 month period, due to having 6 weeks leave so I'll be on leave for part of each qualifying period when I'll get no overtime.

I'll add to that, why the f**k couldn't they just have just stuck with the same full time contract for everybody currently rather than what it might be in the future :arrrghhh :arrrghhh

So if these are the dates being worked to we are actually getting abit more than 2 years back pay as we are now nearly at the end of June or am I misunderstanding?

Kind of yes and no.
The back pay will cover April 2019-March 2021 but I suspect the first of the twice a year payments will then cover April 2021-Sept 2021

Have you got to work it out and put a claim in yourself or is it just gonna be centrally calculated and paid, which could be entirely possible.

I think HR will do the grunt work although it would be wise to do your own rough calculations to make sure they're in the right ball-park. I suspect if you choose to refuse the back pay and take the ET route you're unlikely to get any help from Sheffield.
