Signing for a duty.
If someone has signed for a duty but hasn’t actually been on it for 6 months , possibly 12, should the duty actually be vacant and up to be signed for by someone else ?

The duty holder probably can’t get training on the duty due to no van sharing for training, everything is on hold at the moment.

No that’s not the case here as it’s an hct duty and it was also way before the pandemic.Vwtouran wrote:The duty holder probably can’t get training on the duty due to no van sharing for training, everything is on hold at the moment.

No I’m not saying that , I’m asking if they pick one delivery but never do it and they do a completely different duty and have the rota day off for for the duty they are on , should the original duty not be vacant and be able to be picked by someone else after a certain amount of time.gary1975 wrote:If you mean can somebody else pick there duty, then no they can’t .
Can you or anyone point me to the actual agreement/ process to this ?
Essentially the issue is that one person is occupying 2 deliveries which can’t be right.

It depends whether the decision not to move on to the duty was driven by the member or management.
To be honest without more information as to the reason why this member hasn't moved onto the duty they picked there's very little help anyone could give you but if this member has changed their mind then the vacant duty does not necessarily become available immediately, the most senior reserve may be allocated it for up to six months.

I assume the duty he is actually performing is the vacant duty and he is covering it with the agreement of management. I don’t know of any agreement that says if you haven’t performed the duty you signed for for over a certain period of time you forfeit that duty and it becomes vacant.
If any duty should be advertised it would be the vacant one he is performing but vacant duties only have to be advertised if a certain percentage of duties in the office are vacant.

If the duty is vacant , it would normally be advertised after 6 months

They have not moved onto the duty because they are a driver and the duty they picked is an hct delivery.Woody Guthrie wrote:It depends whether the decision not to move on to the duty was driven by the member or management.

Yeah a reserve has been on this duty for 6 months.
I get that management can reasonably move you to another duty for the reason I’ve given ( they need a driver on the other duty which is a cover duty I believe)
Fair enough if the cover suits them better and that’s not my issue really , more that either one of the duties being occupied should really be vacant and up to be sighed for.
Any agreements on this are rock hard to find.

That's because it's more than likely a temporary solution to the present circumstances.Any agreements on this are rock hard to find.
At the moment your office is short of drivers as most offices are.To be honest all offices are in a state of transition, normal procedures aren't compatible with that. I think demanding that a vacant duty is advertised during this period is probably asking too much. Let's wait and see what plans the business has for us first.

Found this from the Way Forward Agreement.
14.6 When the number of consequential vacancies in the resourcing unit reaches 5%, or after a period of six months following the last such exercise (if earlier), the posts will be advertised in the resourcing unit, en bloc and filled on the basis of seniority. If this results in any further vacancies, these will be filled, using the same process as above.
So duties should be advertised when 5% are vacant or 6 months after the last time vacant duties were advertised, whichever comes sooner.

This has been the case for just over a year. as another bit of information to go with what I’ve already said , the duty they are currently on is their old cover duty.Woody Guthrie wrote:That's because it's more than likely a temporary solution to the present circumstances.Any agreements on this are rock hard to find.

I don’t expect it to be advertised currently but I wanted clarification on the procedure because whenever we do return to normal I want all proper procedures adhered to.
