You can’t be dismissed for industrial action if:

it’s called as a result of a properly organised ballot
it’s about a trade dispute between workers and their employer (eg about your terms and conditions)
a detailed notice about the industrial action (which is legally required) has been given to the employer at least 7 days before it begins
You can claim unfair dismissal at an employment tribunal if you’re dismissed for taking industrial action at any time within the 12 weeks after the action began.[/quote]

if you’re dismissed for taking industrial action at any time within the 12 weeks after the action...what about dismissed after the action has taken place...is that a legal possibility: shedding thousands of pro-union staff in an instant? I fear the union-busting CEO can and will do whatever it takes to drive 'his company' plans forward...the ignorance and hostility toward staff currently felt by 97.1% could be swathed dramatically if he ploughs on :shock:

We had the Management Hand Outs left on our Frames for when we returned today .... Although No Managers! :no no I think we all really need to calm down and stop worrying about "What if situations". I realise this is a discussion forum but I don't think it does anyone's Blood Pressure any good to worry about some situations which are outside our control. :hmmmm

Royal Mails got their Experts, and the Union has theirs. It's an obvious sign of deperation on the Managements part "Clutching at Straws" springs to mind, but I'm just going to let the Experts sort it out and wait to hear the definitive results. :cuppa
