Postal worker from Flintshire hurled racist abuse at pub doorman

A DRUNKEN woman hurled racist abuse at a doorman who refused to let her into a pub, a court heard.


Appearing at North East Wales Magistrates Court, Michaela Ann Childs admitted using racially threatening words following the incident outside the Clwyd Hotel in Shotton on November 2.

Justin Espie, prosecuting, said Cheslin Reid was working as a door supervisor when he saw two females walking towards the pub from the direction of the nearby Wetherspoons.

They were staggering and appeared drunk so Mr Reid refused them entry.



Childs, 29, began “swinging her arms” and becoming abusive saying: “I’ll get people to come down” before adding that Mr Reid had only stopped them coming in because they were white and that he was a “black bastard”.

Stephen Mullarkey, defending, told the Mold court Childs, of Glynne Street, Queensferry, worked as a sorter at the post office and was “deeply remorseful” about the incident as her workplace contained a lot of ethnically diverse people.

Magistrates chairman Nick Colbourne told Childs: “This was a particularly nasty incident and the language you used is not acceptable to anyone these days.”

Childs was fined £250 and ordered to pay Mr Reid £50 compensation as well as £85 costs and a £30 victim surcharge.

It's got nothing to do with her work place as it didn't happen at a RM office or to another RM employee. We all make mistakes and she has been punished.......

Navalron you are wrong in your assumptions.

Her racist behaviour has everything to do with her workplace. Lots of RM workers are from ethnic backgrounds.

When one signs up to Angard don't you have to disclose any convictions ?

Gross Misconduct
The following are examples of gross misconduct:
(a) theft of any property belonging to or in the possession of Angard or Royal Mail, any
employee or customer;
(b) deliberate damage to or unauthorised use of Angard or Royal Mail property or the
property of any employee or customer of Angard or Royal Mail;
(c) serious breach of confidentiality or unauthorised disclosure of Royal Mail
confidential information;
(d) deliberate falsification of records, reports, accounts, expenses claims or selfcertification
forms or any other fraudulent conduct;
(e) refusal to carry out duties or reasonable instructions or serious insubordination;
(f) having illegal drugs at your place of work, on your person or otherwise in your
possession, custody or control on Angard’s or Royal Mail's premises or at any time
during the performance of your duties;
(g) serious breach of Angard's or Royal Mail's rules or other conduct (whether or not
committed at work) which in Angard's reasonable opinion is likely to bring serious
discredit to Angard or its reputation;
(h) violent, abusive, dangerous, bullying or intimidatory conduct towards a customer or
employee of Angard or Royal Mail or any other third party when working for Angard
or on assignment to Royal Mail (whether within or outside the workplace);

Angard Employment contract:

18. Criminal Convictions
18.1 You are required to advise your manager immediately where you have been charged or summonsed to appear before a Court in criminal proceedings (except for a road traffic offence in a private vehicle) or where you have been convicted of any criminal offences(s). If you are convicted of a road traffic offence in a private vehicle off duty and the penalty is imprisonment (either immediate or suspended) or a driving disqualification, that fact must be reported to your manager as soon as possible.

Except of course being a postal worker is a reportable occupation, but more relevant in this situation is that her job and position were mentioned both in the article and during the trial. If Royal Mail believes that they were brought into disreputation or consider her actions as Gross Misconduct then they can dismiss her.

In the article, it says she was contrite and apologetic so that will go in her favour. As usual, it's not cut and dried and without knowing the details of the case I think it's both unfair to call for her dismissal, but also I wouldn't think that it would be beyond the bounds of reasonable actions if she was dismissed.

Mine own point of view is that I hope this was a drunken outburst and that she learns from her mistake, and is truly contrite. Perhaps helping the CWU with anti-racism stuff would help in that regard.

Even if you ignore the breach of contract try to put your sensible head on ...If your criminal behaviour outside of work makes your colleagues uncomfortable to the point where they don't want to work with you what should an employer do?...sack the rest of the workforce?

It's her fault and t's her responsibility if she loses her job, some of the mistakes you make in life can cost more than a £250 fine. That's a lesson most of us learn at a much earlier age than 29.

Yes that's correct, NOBODY, on here knows the case but as usual because it's racism or racist related a lot of people jump on the bandwagon. I have no time for racist people but they do not deserve, most of them, to have their lives completely destroyed because of too much booze. How many of us have said sad, insulting things to our nearest and dearest when have had one too many.

You don't turn into a racist because you're drunk.
Alcohol is a dis-inhibitor, it's not a magic potion.
All booze does is make you ignore the consequences of sharing your thoughts with the world, it doesn't magically change those thoughts.

And we know the facts, they were freely admitted in court and reproduced above. What other mitigation would you propose?

I don't need to propose any mitigation... I've already said that I think racism in any form is abhorrent. She pled guilty, apologised and has been fined and paid compensation. What else do you want. We call, as a society, for people to be rehabilitated. Just because racism is a hot topic shouldn't mean that the punishment should be for her to lose everything.

It's nothing to do with racism being a "hot topic".
She's committed a crime.
It's up to her employer whether they think that makes her a suitable employee. In making that decision they will obviously have to consider how it affects the people who have to work with her.

Most people are full of remorse at a sentencing hearing, that's what your lawyer tells you to do. It's a very poor barometer of genuine contrition.

I have had some communication with Royal Mail HQ today by email.

I only asked questions about Angard workers.

Anyone who is found guilty of a crime however small has to report it to Angard within 7 days in writing. Failure to do so is gross misconduct.

When a crime of the nature reported here by Michaela Childs is reported it would lead to instant dismissal.
