Mine was £10 more than I calculated.

It depends on whether they do the 5% on the gross amount paid each Friday, after 01 Oct to 32 May or whether they use the actual dates worked, for preciseness,

It's supposed to be 5% on everything so a quick calculation from the relevant gross totals on the payslips and adding on October 1st gave me a figure £28 less than I actually got.

Have you guys calculated it based on shifts worked between those dates or payments received beteeen those dates?

Either way, the difference will be negligible.

Having confirmed my own sums are correct, I have emailed them detailing what I calculate the payment should have been using both methods: “shifts worked in the period” and “payments received in the period”. In both cases I did not include any holiday payments, just money for actual shifts worked. The shortfall is 40.69 or 47.49 respectively, which implies that either 813.75 or 949.79 of my wages have not been “topped up”.

I worked it out on the difference for taxable gross totals between the dates, holiday pay included.

Just realised I typed it wrong in my previous post, should have been gave me a figure £28 more than I actually got.

If I ignore holiday pay in the totals then the amount paid is £44 higher than expected so we need the formula as to how they've calculated it. I understood it to be 5% on everything including holiday.

Mine I think was about right so no problem only that it could have been paid 2 months ago. The interesting bit is still to come Angards reaction to the tribunal especially the 30 minute unpaid break.

Still no reply from the email I sent last Wednesday - I’ll be on the phone first thing Wednesday if I still haven’t heard. Everyone else seems to have received a figure closer to their own calculations.

As I read it, a change from the way AWR angardees are compensated for meal breaks & holiday pay at present, following the Tribunal ruling, I assume.

Up till now the higher hourly rate compensated for the disparity with RM employees. I don't see where back pay (surely they will have back-date these deductions also ?) come into the equation.
Your assuming of course that the enhanced rate did cover the 30 minutes that Angard staff were not paid for ? without knowing what the exact rate is for rm staff working a standard 8 hour NIGHT shift I do not know.

I’m still waiting for a response to my back pay query two weeks later. According to payroll, the calculations were done by another team altogether and all email queries are being passed to them. I get the impression there is quite a backlog!

On another matter, it appears from this week’s payslip I have been paid for the breaks I took during last week’s shifts. Has this happened to anyone else? It could be a new ruling, or they may have just submitted the wrong hours in my favour.

I was AWR qualified with Angard for 5.5 years and never had a paid break, so to clarify as I am lost here, am I entitled to backpay for my unpaid breaks for 2 years?

Latest email from Angard. Seems back money for shifts worked in July will be paid this week.

The date that they actually adjust the pay rates seems to have been delayed again. They will continue to pay us the old rate then pay the difference as back pay a month or so later. Confuddling.

Still no reply regarding my query about how the back pay was calculated, and why mine appears to be about £100 short.
We are writing to tell you that we will be paying you a second payment of back pay for the period 01/07/2018 to 29/07/2018. This will be paid on 24/08/2018.

There will be further back pay payments in September and October to cover the periods from 30/07/2018 to 31/08/2018 and 01/09/2018 to 30/09/2018 respectively.

The pay rates will be amended to reflect the 5% increase and there will be a further change in the manner that you are compensated for your meal breaks and holiday pay to give greater transparency. It is anticipated that these changes will take place in early October. There will be a further communication shortly to explain these changes.

Have any union members gone to the union regarding this? There is a guy at CWU HQ who deals with Angard, I will raise it with him and see if he can help, if they DO owe back paid money for tea breaks then every single AWR qualified Angard worker should submit a mass EAT form if possible, they can't hide from that, as it would garner a lot of attention, possibly even media
