We've got a line 'manager' who showed someone's sick note around a few people before announcing "There is no such thing as stress!" to everyone in earshot.

We had another on nights who got a phone call from someone saying he wouldn't be in as his wife had left him that afternoon and he had the kids to look after, then promptly announced the man's situation to the rest of the shift thinking it was a huge joke.

Such is the standard to be aimed at for the potential screw.

If some of these so called managers worked in the pits, docks or factories 20/30 years ago they would be drinking through straws for a good few months!!!

RM send out that `standard` patronizing bullshit letter to everybody inviting you in for a chat to talk about your illness and then to make out it`s a `caring` employer and how they can offer you employment doing something else,they are only doing this to cover there own backs over DDA.

If like me you are a drooling fall over and talk like your pissed type and can just about tie your shoes and dress yourself they will want you to see one of their caring `doctors`usually called Donald Duck who will ask you such great questions like .`So whats up with you then?`How long have you been off?Do you think you can manage a delivery now? Why has your consultant/Neuro surgeon given you so long off?

He will then look at your tonsils,hit you with a rubber hammer on your knee and then pronounce you dead.

Then they will try and pension you off,tell them to stick it up their arse and then hit them with you will be back in xx number of months and you expect them to THEN offer you adjustments to your job,and NOT when they fecking want.

Royal Mail don't like people sh** stirring about absence & ATOS on forums . The corporate way is subcontract non -core services , it suits RM legally as they can pass the buck and play the blame game . An ATOS Origin hack doctor doesn't want to the subject of a complaint to the General Medical Council or be cited in a tribunal , but they are contractors and the golden rule is don't upset the cilent as those jobbing ex GP's are on a good number .

In a nutshell if it got to a 2 or RTU , RM will state there APPEARS to be no underlying reasons for absence , RM will state all absences are geniune but if they can trip people up they will. If ATOS haven't got your records , you are apparently just losing days for unspecified reasons giving RM a reason to urge or give a formal warning, such is Planet Royal Fail . It's a braindead machine and once things come into to play it's difficult to stop it as we all know !

The other thing is when RM "Managers " suddenly become Medical Experts and there's RM "informed " questions that require desired RM answers .
ATOS /RM just want people through the door as cheaply as possible by fair but mostly unfair /underhand means .

Why do they pension people off rather then just cutting the pay down 50% after 6 months?

First hope you get better soon m8, did you not as an after thought consider asking this lady on the phone just exactly what new rule she was referring to in particular.

If it is necessary to commission a medical report on a sick
worker, for example to assess his or her suitability for continued
employment, only relevant information should be sought. This
means that the author of a medical report should not be asked
to provide medical details of the worker’s condition. Instead the
report’s author should be asked to provide an assessment, for
example, of whether or not that worker is fit to return to
employment, whether he or she should be redeployed, or
whether adjustments need to be made to the workplace to
accommodate his or her disability.

The Access to Medical Reports Act 1988 applies when an
employer seeks a report from a worker’s general practitioner or
any other medical practitioner who is or who has been
responsible for the clinical care of the worker. In summary, the
obligations on the employer are to:

• Inform the worker of his or her right to:

– withhold consent to the application being made
– access the report before it is supplied to the employer by
telling either the employer or the medical practitioner of his /
her wish to do so
– withhold consent to supply of the report to the employer once
he / she has seen it
– request amendments to the report before it is supplied
– access the report for up to 6 months after it has been supplied
by the medical practitioner

• Notify the worker and obtain his or her consent to the
application for a report

Workers should not normally be asked to consent to the
disclosure of their entire general practitioner records or other
comprehensive care and treatment records such as those held
by a hospital. Although on occasions an occupational health
physician may need access to the full record, such records
contain more information than the employer is ever likely to
need. Where it is necessary to seek information the general
practitioner should be asked specific relevant questions to elicit
the information needed by the employer.

Royal Mail thinking themselves above the law -well I never !, just got a lot worse with Saddam & Anal and everybody is either frightened to death of them or trying to impress them and their Senior /Area "Mgrs"

Thanks for that , that is interesting -begs quite quite a few questions , certainly proves there's orders from on high to trip people up . All this rubbish about " Best Practice ", what a surprise not . Dragging that Act up in a Tribunal would be interesting .

BASIC POSITION
From an employment law angle, the Access to Medical Reports Act 1988 is relevant in the context of recruitment, health screening during employment, time off for medical reasons and dismissal for medical reasons. The Act itself, sometimes wrongly called the "Access to Medical Records Act 1988", is quite short - only 10 sections in all.

This Act covers medical records held by employers as well as records held by doctors. More accurately it gives an individual the right to have access "to any medical report relating to the individual which is to be, or has been, supplied by a medical practitioner for employment purposes or insurance purposes" (Access to Medical Reports Act 1988 s.1).. It also gives individuals the right to refuse consent for any medical report (as defined) to be supplied by a doctor to an employer or insurer, plus other rights.

Employees and prospective employees should not be sent for medical examination without first being informed of their rights under the Act.

Rights under the Act are enforceable through the normal courts, not through employment tribunals. :whistle :whistle

It amazes me that RM managers seem view themselves as better qualified and having more knowledge than GP's when it comes to medical matters affecting staff. Are they really sent to medical school for four years or are they just lying as usual?
