Don't over complicate everything.

When they call you on Monday and ask the question then answer honestly, but if you wish to proceed, ask if you can give your consent now.

At that point, they will either continue or not. If they don't then your manager will have to restart the process. If they do, then nothing is lost or gained.

The call on Monday and the fact that the manager should have followed procedure are 2 different (but connected) issues treat them as such.

I can only echo the advice from TBT. Play it by ear.
Should The Occupational Health Practitioner not ensure that consent has been given at the outset then you can respectfully remind them of the procedure & the onus is on them to tell you whether to continue or advise otherwise.

that is not the issue , i have explained that i know how the process works and i know it was not applied properly . I take it that if the shoe was on your foot its down to wether a person wants referred or not , not wether it was applied properly .I have the rules applied to me in every aspect of my job , is it different for managers?

I believe the point is a matter of procedure in expecting the OH service guide to be adhered to. Consent by the employee appears to be paramount. "Bloot" says he has not declined consent just never been asked. As OH assist are supposed to ensure consent has been obtained from the employee it is only fair that in that contact it is made clear that he has not refused to give consent but was not asked by his manager as required.

If your really stressing mate don’t answer the phone call,then manager will need to speak to you?you missed automated call aswell,didn’t answer as didn’t recognise number

Ok the manager should have followed the correct procedure for an OH Assist referral by getting your consent but he hasn't.
OH Asssit will at the commencement of the telephone consultation will ask if you have given your consent. That will be your oportunity to halt the forthcoming questions or continue.
If you decline the OH Assist interview then that will give your manager the go ahead to record the fact that you refused the use of OH Asssit and gives the manager the freedom to exercise what he/she feels is the best method in getting you to return to work and this coming from an individual who has no training in occupational health and no medical certification.
Is that what you really want or safeguard yourself with an OH Assist recommendation on the work you are capable of doing, adjusted hours and a rehabilitation plan tailored to your back problem that will be weekly monitored and reduced if found to be necessary.
You seem to be getting all hot and bothered because you have not consented to this but your refusal on the OH Assist referral could leave you in a worse off situation.
OH Assist will listen to your medical condition and give instructions and recommendations for your manager to follow.
If manager fails to follow OH Assist recommendations or attempts to fast track their rehabilitation plan then manager leaves himself or herself wide open to compensation claims and by this time you would have lodged a grievance.

I have been asking my shift/line Manager for a Referral to OHS. And have been told numerous times.that there is no such thing as ohs. Anymore..so I'm unable to be referred. Is this true..or can I phone them myself

You can't phone them.

The manager can't either if I understand the new rules, they have to go through HR first.

What would happen if an employee asked to speak/get referred to OH and management refused?

Have known of this happening.
