Can I ask how they forced you?LouBarlow wrote:Had an accident on delivery yesterday after being forced out in unsafe conditions. Just need to know how I stand (not literally!) when it comes to the legal side of things. Will it be considered a standard accident on delivery, or can I take further action against my employer?

I thought the first port of call for health and safety is yourself you can’t be forced into anything if you deem it unsafe and if they still insist get them to put it in writing

You have to be prepared to justify that call though, it isn't just an opinion thing.terry2972 wrote:you can’t be forced into anything if you deem it unsafe.....

CWU HQ are receiving numerous reports and enquiries that as a result of the severe weather conditions, Royal Mail Managers are attempting to insist that in cases where our members are being sent home early from work due to unsafe conditions for delivery, collections, road services etc, the Pay & Modernisation Agreement and in particular the flexibility clause within that agreement, is applicable.
There is no provision within the Pay & Modernisation Agreement for the clawback of any time as a result of what is tantamount to an 'act of God' i.e. the severe weather conditions that the UK is currently experiencing.
We have had further reports that some Managers are attempting to have our members take annual leave, make good the time, or even in some cases Special Leave 'C' (unpaid) where they could not attend work through no fault of their own. Once again, our representatives should be clear that this has not been agreed with the Postal Department at CWU HQ.
Any enquiries should be addressed to the DGS (P) Department quoting reference number 60000.

It's good to get these types of threads, the ridiculous my manager said bollox, so we can reassure ourselves that while the world is falling apart, Royal Mail managers are still being the low-life C***S they have always been.

The daily grind of having to argue your case with an intellectual pigmy of a line manager is physically and emotionally draining.

They didn't "send anyone home" from our office, just told us if we go out delivering its at our risk, so we all stayed in. What are our rights for going home/getting paid then?

Our office was sent out early with full delivery, conditions worse than yesterday and a Red weather alert.
Get back 40mins early did 80% of our duties and they then ask us to come in early, needless to say we stayed until our finish time.

Absolute mental and somebody needs their balls booted for making that decision! Do they not understand the severity of a Red Warning?nickbsmooth wrote:Our office was sent out early with full delivery, conditions worse than yesterday and a Red weather alert.

That said, as individuals you should have made a dynamic risk assessment as of leaving the DO and all returned due to unsafe conditions!
