Just asking - where does the judgment say that RM have got to appoint the mediator (and not CWU)? (Perhaps I've missed it in all the legal
doublespeak). I thought the clauses the judgment refers to state that either party can refer to external mediation and that
the mediator must be jointly appointed or if one can't be agreed on then ACAS will appoint.

Are RM going to turn round and say that it's not their call to refer to or appoint a mediator (delaying tactic). As far as I understand what's gone
off is that RM asked for a judgment to declare strike action illegal because it hadn't gone to mediation (which they were obviously successful at).

Should CWU take the bull by the horns and attempt to refer to/appoint a mediator? If CWU do this and RM turn down the appointment this will
surely get it referred to ACAS quicker and look better for us if it goes to court again.

yellowbelly - that's what I was going to ask - seems like more delaying tactics.. are the CWU going to hold them to account on this. can see the first IA date going into next year at this rate.

Why isnt the CWU giving strike notice for the first working day after the 16th Dec, when the 7 week period is up ?????, take the upper hand FFS. because if you dont I think you'll find a lot of people leaving the union.

A 2 day strike a week before Xmas and the loss of £200 bonus wouldn’t go down well with majority of people it would also have the added bonus to rm of saving them a fortune

For one the injunction does not allow the CWU to announce strike action during the mediation process and secondly on the ex IWM bonus part of your Christmas bonus £100 pro rata you lose only 3% per day for strike action based on the two week christmas period and for the Chrirstmas bonus linked to the ex Colleague share there is no abatement for Industrial action.

Royal Mail and the CWU have an agreed panel of mediators , however it is normal for Royal Mail to organise the mediators as they pay for them. Mediators do not come cheap around a grand a day plus expenses so that is paid by Royal Mail after all they wanted mediation.
