Just added urbanpirate to my foes list via the user control panel. Fantastic that I no longer have to read his nonsense. I suggest that others do the same if you don't want to read management views, had enough of that during their failed propaganda campaign.

Has it occurred to anyone that wildcat/illegal strikes are exactly what RM are after?
That way they may well be able to impose new ways of working on the ones that take this action.
Seems to me that the delaying tactic they are using now is a way to wind the workforce up even further and play into their hands.

I really hope so.
If they rule it unlawful (which I doubt, looking at evidence available to us, at least), the wrong thing to do would be to blame RM for this, get all upset, and walk out en-masse.
I certainly wouldn't be joining in with action like that.
Let's all keep a cool head and do this properly.

The court case is scheduled for 10:30 on Thursday at the High Court in the Strand.. The CWU will holding a demo/rally before the court case. All are welcome.

Area rep reckons we will strike even if judge rules against us !Think that could be very dodgy as people will panic and work !.If only a few on gate then its bye bye to them

Royal Mail’s application for an injunction against the CWU’s announced action will be held at 10:30 on Thursday in the High Courts in the Strand.

The CWU will be holding a demo / rally at the High court in the Strand over Royal Mail’s pathetic attempt too silence the democratic right of Postal workers who voted by 89.1% too strike. All are welcome. We realise many will be at work but you can send messages of support.

This demo and the voices of Postal workers must remain united and signal to Royal Mail that you may use the courts but you will never have peace in the workplace until you change your proposals on pay , pensions , start and finish times , team working , route ownership and all the other attacks.

Moya you have lost the confidence of the workforce , we will not bow down and will not waver in our determination too fight to ensure we get the right deal !

It's good to get these types of threads, the ridiculous my manager said bollox, so we can reassure ourselves that while the world is falling apart, Royal Mail managers are still being the low-life C***S they have always been.

A high court injunction is a serious thing. If our union chooses to ignore it, then all of the unions's assets could be seized and our leaders fined for contempt of court
"26 OCTOBER 1984 – National union of Mineworkers rejects NCB demands. High Court orders total sequestration of NUM funds.
28 OCTOBER 1984 – Court moves to makes 24 members of the NUM executive liable for the £200,000 contempt fine."
If RM obtain an injunction it simply postpones action.
A full hearing of the court would be scheduled, which may end the injunction or issue a full order requiring RM and the CWU to external mediation set up by ACAS with independent parties. That process is scheduled for 5 weeks. Once that is over, either the CWU and RM come to an agreement. Or either party go back to court to get the injunction lifted. Once lifted, if no agreement has been reached, the union can give another 14 days notice of strike action.
Btw, Our union has always had the opportunity to go to the High Court to seek legal remedy for RM breaking any of the terms of the Agenda for Growth agreement. One of the questions we should be asking is why it has never done so.

Just to correct a few lies on the thread a local office could legitimately ballot its members over any local issue, as long as procedure was followed ( rule 13) it would neither be wildcat or unlawful, neither would it be in breach of any court injunction.

No matter what kind of action was taken individual members would not be in breach of any court injunction, the union could be if it was shown to be orchestrating local action at national level but not individual members, they are not named on the injunction.

I'm obviously not advocating anything, just giving the correct legal position.

I hope that the union have thought this through and were prepared for the very real possibility of Royal Mail seeking a High Court injunction and therefore be able to counter any such action.

To get to a rule 13 situation, would you not have had to involved external mediation first?

Many of my colleagues are of the opinion that it doesn't matter what the court decides, they will be out for those two days regardless. :shock:
