When did Notice period change to 4 weeks?

I have a member who wishes to quit the job and go to another one :) however the DOM is stating she has to give four weeks notice.

she joined in April 2016 and I thought the 4 weeks notice as a fairly recent addition to the contract.

She has never signed a contract as there was something wrong with the original one and she was never offered another one to sign.

I too need to know this answer as I intend retiring next year and do not intend giving RM more than they are entitled to re notice. Weekly paid, weekly notice (or so I thought) after 17 years in service.

I suspect DOM is getting confused by the notice RM have to give you should they not re-new contract...but could be wrong on this.

he's probably read it wrong, 1 weeks notice to leave, it's more likely 4 weeks notice for them to finish you

Appears to be the case

My contract 2015 states;
Notice of termination. 13.2 If you wish to leave Royal Mail employment you must give one week's notice if weekly paid or one month's notice if monthly paid.

13.1. If Royal Mail wishes to terminate YOUR employment ...., you will be given a minimum period of notice as follows.
Less than 26 weeks .... 1 week
26 weeks or more but
less than 2 years.........2 weeks
2 years but less than 4 ..... 3 weeks
4 years but less than 5 ..... 4 weeks

And so forth up to 12 years or more ... 12 weeks

EDIT; I have since spoken to newly contracted employees who have confirmed 4 weeks notice IS required for weekly paid staff.

Just because their retiring doesn't mean they will be taking their pension. I've retired early and don't intend to take my first pension until I get to 60, which for me is nearly 6 years away.

very new contracts have to give a 4 week notice period, it changed very recently, everyone before that is a weeks notice only as you get paid weekly.

need to know when it all changed to 4 weeks notice, I am sure it was april this year but no hard facts.

Thanks for your concern :thumbup

Rest assured Chesterfield will be told when I want to take my pensions - in my case taking both NRA60 and NRA65 (with deductions obviously) when I turn 60. And yes Chesterfield will be informed well before the end of 2017. That bit is really easy. :Applause

What I will need to decide upon is exactly when I stop working - exactly 60, or 60 + 1 month etc and when I know that for sure, I need to give RM the required notice. :hmmmm

Beamishstout, it's one week mate.

the 4 week notice period came into force for the new starters in April this year. Everyone else is still one week ( unless monthly paid )

Just leave, what are they going to do not give you a good reference? Do you honestly think that by honouring a 4 week notice you are going to be held in high regard by the management and given a glowing reference? Chances are they won't remember you from Adam 2 weeks after walking out the door, if they can't be arsed to do things for you when your under their employment what makes you think there attitude will change when you are of no use to them.
If you've got another job and are not owed any outstanding money, then just walk.........

If they have changed it, I suppose technically they could sue you for breach of contract. But would they spend thousands taking it to court. Not to mention the fact you have a different notice period to the vast majority of staff. Doesn't sound fair.

I started in April and am require to give 4 weeks notice if I should want to leave. I think RM have to give me one weeks notice if they want to terminate my employment.

Surely, because your co-worker hasn't signed a contract, she is not obliged to give any notice whatsoever?

My contract from April/May 2017 also required me to give 4 weeks notice.
I agree with other posters that if the person mentioned by the O.P. has no contract then RM will not be able argue the point. Why not just ask the DM and/or HR for a copy of her contract signed by her? If they can't provide it then they can't complain.

If you read legal advice online on this it usually says "the company could sue you for their losses but in reality this rarely happens"
They have to prove that you leaving early caused them financial loss, which apparently is very difficult.
Can you see RM bothering? What is the loss? The legal costs are probably way more than a few weeks postie wages? It is illegal for them not to pay you for the work you have done regardless.
My partners firm immediately agree a short notice period if they can and then put the employee on gardening leave and pay them off because because they feel it is bad for company image to have people who want to leave at work, because they can bad mouth the company, encourage customers to use competitors and experience shows they let the company down with poor attendance/sickness in notice periods.
One thing for sure for me when I decide to leave because of the frequent "errors" in wages I will not be working any overtime in the notice period!!!

Confused... You won't be, after the next episode of. SOAP
