we walked out AGAIN today

well, that's the 2nd time in less than a week. after the last walkout the DSM promised everyone would get paid for the polling cards. even the ones who handed back or didn't go over. yesterday DOM told us 6 people where not getting paid, namely the ones who constantly hand back. the area rep challenged him and asked what about what the DSM said, he says this has COME from the DSM. rep emailed him to ask if there had been a misunderstanding at the gate or was he reneging on his promise. DSM says he NEVER said everybody was getting paid. now we all know for a certain fact he DID say everybody was getting paid. there was 50 odd witnesses. so out we went again....this time we were out 2 hours. area rep came.. DSM came... much to-ing and fro-ing, then DSM says ..look EVERBODY WILL BE PAID. we went apeshit... saying YES you are saying that now cos we are out AGAIN. we weren't going to go back in at all til they got it all sorted, but rep and DSM were saying it will take at least a week for clarification even if we stayed out. so we voted. decided we would go back in,,, BUT, on OUR terms. we are now working to rule. NO earlies, NO overtime, NO working days off, EVERYBODY cutting off or handing back. the second wave driver came up, he wouldn't cross our line. so it all went back to the mail centre. when we went out this morning EVERBODY left loops. we came back on our times and the place is absolutely crawling with DSMs and directors, all top senior gaffers. all the second wave was all prepped in on everybodys frames. they know its all going to fail tomorrow cos no earlies in and nobody extending. they are literally f****d!!! who says work to rule wont work? it IS. we are doing it.

a question for dingo though, or any rep who knows really. is it in the union agreement that they can refuse to pay us for election mail if we don't go over or hand back?? we asked the area rep at the gates this morning, he didn't know. he phoned the div rep, HE didn't know. he emailed a copy of the agreement (dated 2003 or 4) none of us can see anywhere in the agreement that they can refuse payment for not going over or handing back. I don't know why they couldn't just get in touch with hq for clarification. but NOBODY seems to know. does ANYBODY know the answer. can they refuse payment for not going over or handing back???

Quality Commitment.
The payments are based on the requirement that all election material will be delivered in
accordance with the delivery specification set out in paragraph 3. Where the specification
is not achieved for any party/candidate then the payment for that party/candidates
material will not be due.

If it isn't delivered to spec, then the payment isn't due.
Those are the words of the agreement.

there are people exempt from this though clash, as we found out this morning. the div rep said family friendlies or people who have hospital appointments WILL be paid. this puts an ''unfair'' emphasis on this agreement to say the least. someone could maybe leave 2 loops in for family friendly commitments and someone who doesn't want to go over hands a loop back. the f/f gets paid, the other one doesn't.

it also doesn't say in that agreement on 1 day delivery specification. which is what we found ourselves having to do. we had 1 day to deliver it. not 3 or 7 but 1. this caused massive problems. people handed loops back but still delivered 6/7/8 hundred poll cards. but because you handed back, you were not paid anything.

In the case of polling cards that would only apply to cards not delivered, if you tried to apply the principle of all or nothing anyone who brought back a missorted polling card would receive no payment at all.Even if it was applied it would have to be communicated beforehand and the staff offered the option of not delivering any cards at all or claiming overtime for the cards delivered if it meant extra time in prepping or delivery. Polling cards are not part of workload hence the payment. It's a weak defence that's obviously by its wording not meant to apply to polling cards which neither have a party nor a candidate.

Well done, wish all offices could unite like this perhaps we could then stem all these daft changes that just don't work and stop RM bosses taking the piss all the time!

So, what about in the event of 3 or 7 day contracts?

In our case, we walked in this morning having had 3 day election material fully prepped into the frame by the DOM (we are deemed to be a problem walk, loops being brought back every day). Today being the first of the three days. We brought back 2 loops and were told we wouldn't be paid for the election material, despite the fact we had ALL the material, and despite the fact that, as we rotate which bags/loops get returned, they will be completed tomorrow...by us.

I'm fairly certain that we have met the requirement for delivery, so what gives? Should we get paid?
