I would have thought the obvious fair tie-breaker would be attendance over their employment but not including time off due to an accident at work

So what if one has a disability or long term problem/illness, maybe family problems that need time off to sort? You are not allowed to discriminate on health grounds or against family friendly issues? i've been discriminated a few times over family friendly issues, i had to alter a few things, not ideal but it was the only way

Well my main point Korky is that there can be many reasons for someone to have a weak/poor attendance record so I don't think that would be a fair decider really. Toss of a coin, ride your luck with both parties having an equal crack at winning. That would do me!

but yeah, there will be loads of reasons for absence and not sure if rm keep the entire service history of us all, but where do you draw a line to keep it fair other than a gamble like the op posted.
say 1 lad has 1 day off with the two bob bits in 5 years, the other shagged about and got caught and takes 6 weeks off due to family issues not declaring the full sp
by your method the latter gets in but is it fair?
end of the day, if we worked for a decent employer they'd both bloody get ft!
