Fair Enough we should always use the seatbelt! As previously mentioned..... It would be interesting to have Duties tested "Correctly", with the seatbelt being worn for every move, and perhaps with mail in the rear etc!

I think we all get the message that Seat Belts are to worn whenever moving the vehicle.
Having said that there's a lot of difference between the various driving duties. I've done some were the vehicle was only moved a dozen times during the whole duty....Not too much trouble using the seatbelt. Yet others I've counted moving the vehicle 65 times!
The seatbelt then becomes a factor!
The same goes for the RM Video about the correct way to park the vehicle.
Fair Enough we should always use the seatbelt! As previously mentioned..... It would be interesting to have Duties tested "Correctly", with the seatbelt being worn for every move, and perhaps with mail in the rear etc!
We all know that's never going to happen!

Just noticed the mention of human rights. lololololol. If a manager knocking on your door is a breach of human rights, then surely us knocking on people's doors every day is a breach of human rights too. "damnit postie, you're always here spoiling my PRIVACY!"
Though in fairness, I went by a house today and the gentleman inside was quite clearly watching porn in his living room - I'd quite accept it if HE told me I was breaching his privacy...

Oh jesus - don't tell me - people only want privacy when they have something to hide ? And if you've got nothing to hide then you have nothing to worry about. Is that it ?
Tell you what - let your life be a transparent and open book - and let me have my privacy. OK ? Its no skin off your nose is it ?
If you don't have privacy you don't "own" your personal experiences. You have nothing. Who are you ? You are owned.

Not really - the internet isn't working in a way that it was first envisioned by the pioneers that it might or ought. Check out Maidsafe and end to end encryption. Hey, even Google and Apple are going in that direction - and thats saying something. But I reckon its what the market wants/is the future. Most people are busy sharing their lives on Facebook and haven't really had time to think about the implications yet - but they will.
I want to use technology to serve me and let it grant me the freedoms that the well off have benefitted from for a long time. And in my daily life I would like, where possible, to have the same freedoms. I should like to express myself and my individuality in a way I see fit without having to answer to either idiots or GCHQ. This forum will be monitored BTW.
But listen, if you want to give it away for free, go ahead.
But don't ask me to. Or try to make out I'm a whacko - cos I'm not.
Sorry to go off topic OP - kind of getting pulled that way. Its all relevant.

As I've said further up this thread, this one's a full-on conspiracy theorist.
Clearly his "professional legal training"
helps him to recognise all the dark forces out to get him, although raising his concerns (even GCHQ) in a thread about seat belts takes it to a new level of C/T-ing!

A little tip wee man - if you've got nothing to add, then its usually best to keep your mouth shut.Tman wrote:As I've said further up this thread, this one's a full-on conspiracy theorist.

It has gone off topic, but this hasn't been helped by a) someone bringing up an old thread about privacy b) trolling/shilling by the likes of you with talk of conspiracy theorists.
Sorry to OP. In answer to your question - no, its not illegal to wear a seatbelt.
I am outta here now.

My God, how many years "legal training" did it take for you to be able to give that particular pronouncement?

I don't understand why people think facebook is so evil. You don't put your address or bank account up there (at least nobody sane does) so what harm can possibly come of, at the most, sharing where you work and some pictures (mostly of your meals apparently)???? anyway, that is off topic.
I'm more interested in discussing the merits of VW vans over the Peugeots! Not a fan of these peugeots myself, they do the job but the steering feels like it's held together with rubber bands and the pedals feel like they've got sponges in them. Though our lone big Peugeot Boxer feels a lot more refined. We've got a few Fiat vans at our place too, they are much more refined and feel somewhat more like driving a car.

IMHO they would have a hard time generating a dismissal over finding a van in the yard with the passenger seatbelt plugged into the drivers side. (Well, unless you confessed when confronted with it.) Yes, it's highly suggestive that you've been driving around not wearing a seatbelt, but it's not proof. (To take my office as an example, if I knew management where going to be checking I could get the keys to someone else's van when I got back in the afternoon and do it to their van, and thenmjt120 wrote:We've been told by our manager any vans he finds now with seat belts like this that driver will be sacked, think we had a few problems on last audit for vans, can't understand why you wouldn't want to wear your seatbelt and keep safe, but seem to be persistent issue at our office.
One of my colleagues suggested to me in the past that the way to do it is actually to connect up the driver's seatbelt behind you. That way if you see a police-car coming the other way you can swiftly pull the top bit of the belt over your head and it looks like you're wearing! But personally why risk it?

Leaving aside the inference that someone else could have fixed the seatbelt, people need to recognise that Royal Mail does not need proof to dismiss. It's not a criminal trial where they have to prove their assertion beyond a reasonable doubt.
All they have to do is make a reasonable decision to dismiss, based on a reasonable investigation of the information reasonably available. They do not have to prove anything.

Dismissal of an employee will only be fair if the employer can show that the reason for it was one of those listed below and, except where the reason for dismissal is the retirement of the employee, the tribunal is satisfied that the employer acted reasonably in the circumstances in treating that reason as sufficient to justify dismissing the employee.
The reasons are:
a reason related to the employee's capability or qualification for the job;
a reason related to the employee's conduct;
from 1 October 2006, the retirement of the employee;
redundancy (broadly, this is where the employer's need for employees to do certain work has ceased or diminished or is expected to do so);
a statutory restriction on either the employer or the employee which prevents the employment being continued;
some other substantial reason which could justify the dismissal.

So like I say TBT it's wide open to abuse,an extreme example being,management wanting to get rid of someone who is a constant pain by refusing to do overtime and cutting off,so allocate him or her to a driving duty and the next day rigging the seatbelt of the van they used,what defence have they got? maybe I'm being paranoid but it's possible.

Oh it's not only possible, in a way (but on a different subject) it has already happened. David Mitchell from Cupar.
But if members tried to prove that they didn't do it, they'll probably fail. Once its got to the dismissal stage then you'll have to try and prove it wasn't a reasonable decision, or that the investigation was flawed in some way. When it comes to defending your job it's better to know where you stand and strategise from there.

It is not a criminal offence. It is an offence against common sense ,however.TrueBlueTerrier wrote:https://www.gov.uk/seat-belts-law/overview
The Motor Vehicles (Wearing of Seat Belts) Regulations 1993 require that every personYou must wear a seat belt if one is fitted in the seat you’re using - there are only a few
(other than a person under the age of 14 years) shall wear an adult belt when:
(a) driving a motor vehicle
If you are not wearing it properly when you are driving then you are not wearing it. Ergo it is a criminal offence.

The daily grind of having to argue your case with an intellectual pigmy of a line manager is physically and emotionally draining.
