Royal Mail insists Cupar postie won't be re-instated despite wider strike ballot

Royal Mail has insisted that sacked Cupar postie Dave Mitchell won’t be re-instated as the threat of widespread strike looms.

Members of the Communication Workers Union in the KK, KY and EH postcode areas are set to be balloted later this month with a view to taking industrial action in support of Dave, who was dismissed amid allegations of stealing mail.

No evidence was ever found and Royal Mail has twice been told by a tribunal judge to give him his job back.

Dave’s colleagues in Cupar have twice walked out and now action could spread to some 3000 postal workers.

Responding to the latest development, a Royal Mail spokesman said: “Royal Mail is still hopeful of finding a resolution with our union and our people on this local issue to ensure that customers do not face any disruption.

“Our customers also expect Royal Mail to do everything in its power to protect the mail we are entrusted to deliver. Following an investigation Royal Mail considered there to be reasonable grounds to suspect wrongdoing in relation to test postal items and Mr Mitchell was dismissed.

“We will not reinstate Mr Mitchell, as we believe that the trust between employee and employer has completely broken down. As we feel unable to reinstate Mr Mitchell, the judge ordered Royal Mail to pay additional compensation, which Mr Mitchell has now received. The legal proceedings have now concluded.

“It is also relevant to note the judge’s comments. In the original judgement he stated: “In a case like this I am not in any way attempting to determine the claimant’s guilt or innocence.”

I smell a rat here. they are covering something up. no proof whatsoever, and a sting that failed miserably to get any results. why then is he not being re-instated. this is so wrong in every sense.

He will not be taken back until the person responsible for the frame up is deemed too expensive to keep - so make them pay. Dave's return to work would make that person's position untenable but it will have a value attached to it, it now remains for his colleagues, and if necessary the wider workforce to see what that price will be ... but on this issue they MUST NOT GIVE UP !!!

If they had reasonable grounds to suspect him based on test letters, surely that evidence would have been submitted to the tribunal and with that evidence the chairman of the tribunal would have directed a result in favour of Royal Mail. It is fairly obvious that Royal Mail's evidence was not conclusive and therefore Royal Mail should consider the impact to Mr Mitchell's colleagues and also to Mr Mitchell of not reinstating him due to lack of plausible evidence.

If RM are point blank refusing to reinstate the man, how can they be hopeful of finding a resolution?

If an individual defies the advice or sanctions imposed by a court (or judge) there are usually some punitive penalties. It would appear Royal Mail Management seem to believe they are above the law... which quite frankly I find rather disturbing

What about a National Strike... Dave Mitchell was found NOT GUILTY... I find the current situation unbelievable... and unacceptable ?

the RM spokesman tries to draw attention to the 'relevance' of the judges comments that he was not establishing dave mitchells guilt or innocence. which suggests their grounds for dismissal are being overlooked. however, they also say they considered that wrongdoing had taken place and there was reasonable grounds to believe this, they don't mention that the judge completely disagreed with this decision TWICE.
