WhAt if you went off with an injury they know you've had bother with for a long time , came back and the only way this injury was to heal itself was to stay off work for at least a month wud they issue u a further stage or even try and sack u

I believe they would follow the procedure and issue another Stage. But you should not be sacked for being off work due to work-related injuries. So if the injury was a result of work then even if you go to Stage 3 they should not sack you for being off repeatedly from a work-related injury.

For the purposes of the example i assumed your warning is issued on 29th Jan and you go sick 30th july then the answer is no as all your previous absences cannot be counted again. Also, warning issued 29th jan you go sick once for between 1 and 4 days and the last day of the absence either overlaps the 6 month (29th July) period or finishes before 29th july then you are or should be removed from the proceedure as you have me the required standars as laid out in the national agreement.

Or the simple answer is no.

I agree but you shouldn't start to think that you cannot be sacked for absences resulting from an AOD.

Sorry to jump in here, but I have a member that triggered a stage one back on the 4th Nov. No meeting has been had so yet to be officially issued with it.

how far can it be back dated before it deemed too late to issue?

The good news is
All absences up to the day of the meeting will be included in the attendance discussion for that review
As to the time limits, nothing is mentioned specifically, but it has to be at least a reasonable amount of time and 8 weeks (even at Chistmas) couldn't be considered reasonable in my opinion.

What the attendance procedure says is:
Attendance Review meetings

When an employee’s attendance does not meet the required standards, consideration will be given to arranging a formal Attendance Review Meeting between the employee and the manager. If an informal review discussion has not already taken place, the manager should consider why they or the employee have not asked for a meeting and be prepared to discuss the reasons.

This is still quite difficult to get my head around, so here is an example.

Say I was issued with a stage 1 in May last year - I had one absence in September (i.e. within the 6 month period) and nothing further - so 6 months after the stage 1 you are removed from the stage despite this one absence? So I came off the procedure in November?

Thanks again. I've read through it, and can only see reference to the 4 days you mention, for those on a Stage 2 - i.e. if you are issued with a stage 2, then have less than 4 days absence in the next 6 months, you are removed from the stage completely. It doesn't say the same thing happens for a stage 1, unless I am completely missing it.

If you could point out the relevant sections I'd really appreciate it. Thanks for your help so far

If you have more than one absence of three days or more you will not be removed from the procedure on a stage one warning during the first six months of that warning the rest is in that agreement.

So basically, to clear a stage 1 warning completely, you have to do the same as you would if you were on a stage 2? i.e. just one absence of 4 days within the 6 month period? I presume then, that if you go over this 4 days, if already on a warning, that your 6 month warning period starts again, and you have to try to have no more than one absence for the next 6 months? My head hurts :crazy:

You can see why it comes across as confusing when looking at this grab from the agreement - they don't really make it clear how you remove yourself from the process, if on a stage 1.

Don't have a day off in the next six months of a warning if you can help it and you are off the procedure.
