Our client, Mr Stephen McDermid, suffered stress and depression because of the bullying he was experiencing at work. Stephen's case is an example of how employers must take steps to deal with bullying in the workplace.
Stephen's Case
Whilst working for Royal Mail, one colleague in particular began targeting Stephen by treating him differently to other colleagues, knocking over the post that he had sorted, and making claims that Steven wasn't doing his job properly.
Stephen explains how even colleagues that were good friends of his were afraid of the bully, and stopped talking to Stephen when he came over, as they too feared being bullied.
The effects of the bullying caused Stephen to feel down not only at work, but also back at home. Stephen's doctor told him that he was stressed and depressed, and prescribed him medication to help manage this.
Failing to Resolve the Bullying
Stephen said that he voiced his concerns numerous times to his employer, but nothing was done to resolve the situation. At one point, Stephen was even told that action wasn't to be taken against the bully because they needed him in the office.
How We Helped
We were able to secure Stephen £3,000 in compensation for his occupational illness caused by the relentless bullying he experienced. Clive Loxton, a solicitor based in our Cardiff office, was able to settle Stephen's case after issuing court proceedings and disclosing medical reports. Clive notes:
"Cases like this highlight the possible bullying culture that exists in some working environments. Employers must recognise the damaging effects that bullying can have, and should not ignore concerns raised by their employees."
Stephen advises that others in a similar situation should get help; "Nobody should have to put up with bullying in the workplace. If this is happening, people should get help from a solicitor."
Personal Injury and Occupational Illness
Stephen was eventually required to take early retirement, as not only did he suffer from stress and depression from the bullying, but he also sustained physical injuries at work. Stephen developed Carpal Tunnel Syndrome when his employer put him onto a far more demanding shift pattern.
Clive was able to secure Stephen a further £7,000 for the personal injuries caused by his employer's failure to make any adjustments. Clive explains:
"Occupational illnesses, like physical injuries, or stress and depression, must be taken seriously. With regards to the two separate claims we made, the Royal Mail failed to address the problems Stephen was encountering and this caused a huge amount of unnecessary upset and distress."

More to the point is when will they take action.When it's reported to them and they just turn a blind eye and hope the problem goes away,well it doesn't .Once a bully ,always a bully.It won't be the first time somebody has lost their life due to bullying in Royal Mail .In my opinion in that case all those managers from the bottom to the top should of stood trial for corporate manslaughter.
It is both disgusting and disgraceful that this still goes on and Royal Fail try to downgrade it to a grievance,
Mediation does not work with SERIAL BULLIES
But the worse thing is the so called friends that say " I didn't see anything" just to have an easy life,
GROW APAIR OF BALLS AND OWN UP TO WHAT YOU HAVE SEEN YOU MIGHT JUST SAVE SOMEONES LIFE !!!!!!!!

Hear Hear! And the rest - she should already be locked up for ignoring one of Her Majesty's judges. Ref: David Mitchell Cupar, fired by RM for something he didn't do, got criminal conviction chucked out, won his tribunal and judge ordered reinstatement but Moya's henchmen stated that RM would not reinstate him under any circumstances. It's not so much Royal mails failure to address bullying is the fact that they actually condone it.I know of one manager who had a string of complaints against them from our office alone that resulted in 3 people being off with stress,the manager actually thought it was funny that they had been accused of bullying,all that happened was that they were moved to another office.fishtank wrote:So the bully won?

I have worked in a number of areas and functions and would have to say that the difference is astounding. Manager on Manager bullying is almost condoned in some areas where the Annual Performance Review is also blatantly used to victimise people. I have personally witnessed quite Senior Managers talk to OPGs in a manner which would not be tolerated outside of work - so why is it allowed inside?. It's not as if no-one knows what is going on , everyone right up to and including Moya Greene knows and the buck must stop with her. I've had some fantastic years working for RM and a few which caused me stress which were purely down to the fact that I was outside a clique and was not being treated the same as everyone else. My decision to take VR, probably 3 or 4 years before I wanted to, was based mainly on the fact that my new line Manager had just returned to work having been suspended on full pay for B&H.
