A MAN who drove in front of an oncoming police car as he left a pub was asked by officers how much he had had to drink and replied “too much”.

Magistrates heard Matthew Peter Kelly, 32, was found to be three times the drink-drive limit.

Kelly, a postman from Llys Padarn in Ewloe, admitted driving with 108 microgrammes of alcohol in his breath compared to the legal limit of 35, and was banned from driving for 25 months.

Appearing at Flintshire Magistrates Court at Mold yesterday he was placed on a 12-month community order and must carry out 80 hours of unpaid work.

Kelly was also ordered to pay £85 costs, a £150 criminal court charge and a £60 surcharge.

Kelly was seen pulling out of the car park of the Crown and Liver pub in Ewloe on Sunday, November 8.

“He pulled into the path of the police vehicle which had to take evasive action,” prosecutor Justin Espie said..

The vehicle mounted the kerb on the opposite side of the road and he then accelerated towards Ewloe.

He was followed and stopped and when he got out he was said to be unsteady on his feet. “Asked how much he had had to drink, he replied ‘too much’,” Mr Espie said.

Stephen Mullarkey, defending, said his client was a man of no previous convictions.

He had a very supportive reference from the Royal Mail and was full of remorse.

Kelly had also written a personal letter of apology to the court, Mr Mullarkey said.

Probation officer Pamela Roberts said Kelly had a “few issues” and went for a drink with friends, which he thought would help him forget his problems for a while.

In alcohol, he decided to drive home but realised he should not have done so.
