Good Day,
My problem in the workplace practically started from the beginning of the work in the RM that is more than 5 years ago. I was treated differently than other employees.
I worked from the beginning 6 days a week, day or night, as the driver of the van and picker / loader. No life after work. I must mention that I am a Pole and in the UK there are more than 11 years. My parents and my children live in Poland also I'm here alone.
I always added some extra work week also worked for about 70 hours. At Christmas and Easter I did not get leave because this is the policy of the RM so I'm told.
After a year or in November 2011 I decided to apply for a transfer as a driver Class 1 C + E.
Previously, he worked on international routes as LGV Class 1 Driver also have extensive experience. To this day I'm waiting for the shuttle. I have all the documents and qualifications.
Over 4 years, treatment of depression, high blood pressure and gout.
Unfortunately, in 2014 August 27 While on holiday in Poland underwent heart attack. Inserted me stent of one of the chambers.
Unfortunately, my health did not allow me to return to the UK because I hoped for another surgery who, after many trials I went through in January 17 2015. Me a second stent implanted into the second chamber of the heart.
Throughout the stay on sick leave which it has issued me and lengthened my UK GP.
I keep informed RM management in my hub all the time .
Over the entire period of stay on sick leave I was a stressful and harassed phones and emails when I return to the UK.
Nobody paid any attention to my health at work.
I was informed of the RM only lose money by my dismissal.
In the end, my sick pay was stopped.
I returned to the UK 22 March 2015
Since then I waited at home on return to work.
Incompetence management at work caused him to get back to work 5 June 2015. Atos recommendations were not followed by management and refuted twice. Management does not he found me a lighter work or shorter working hours as recommended follow Atos and my GP.
Disregarded all reviews Atos my GP and doctors of cardiologists from the hospital.
I have all the documents.
I have not had any risk assessment and return to work, or any information what to do.
Just after a week driving to another driver returned to his route that includes not only the delivery of heavy parcels up to 40 kg, but also, and collections of bags so-called Sensitive Waste from different places in quantities up to 100 bags.
September 2, 2015 before the start of my shift about 4 am without any notice day shift manager informed me the next day I walk to another route that you've never done before. I am a Full Time employee of RM no driver or driver agency or reserve.
Treat me disrespectfully but at least now I know that this is simply discrimination because I am a Pole as well as current disability under The Equality Act.
I do not know how longer I can handle that work in constant stress and the worst do not know how long endure my mental and physical health.
I would also like to add that several weeks ago when I wanted to know if I have days leave last year, accidentally discovered the faked my signature and handwriting on the Holiday Leave App. in April this year when I was on sick leave! It's completely moved out of balance and I really do not know what to do.
I can not count on help from my Union Rep due to a conflict of interest in my work.
Forgive me for the comprehensive presentation of my case but I do not know to whom I can turn to.
Thanks in advance for any assistance the answer.
Kind Regards,
K.

You could enter a grievence and if your rep cannot help you, for whatever reason, you are quite within your rights as a member to go over their heads to the Area Rep for your function.

I would suggest you put in a grievance against your manager, ask your rep how to do this (you need to fill out a HR1 form and also make a copy for yourself). If your rep won't help you contact the AREA REP.

Don't put a grievance in as nothing ever gets done about it. Plus the union lad is probably bests chums/in cahoots with the person you are putting a grievance in about.Jpro747 wrote:I would suggest you put in a grievance against your manager, ask your rep how to do this (you need to fill out a HR1 form and also make a copy for yourself). Re: Need help and advice on violations of rights in the work
Hi K, OK basically to summarise that
1) You feel you have been discriminated against since day 1. OK that may be true but you would have trouble proving it without diary entries and records.
2) Your doctors advice over light workload is being ignored despite your serious physical and mental health issues.
You have a few options.
1) Hand in your resignation and take RM to court for constructive dismissal. This means they have made it impossible for you to work and so you have been forced by their actions to leave work. You may have a strong case but should seek advice from your local Citizens Advice Bureau office (https://www.citizensadvice.org.uk/" onclick="window.open(this.href);return false;) or a solicitor. Before you resign you likely need to write a letter to your DOM with a copy of your GP's note saying you MUST be put on light duties. If they fail to act you are in a strong position.
2) Call your AREA union rep and tell him you desperately need his help. Your local rep should help you no matter what personal issues you have with him. He is a rep as a professional position and should treat you like everyone else. Go to the CWU website and email them to find the phone number of your area rep.
We have Poles working in our office and they are treated like everyone else. RM managers are very bad. It is possible you have been treated badly not because you are Polish but because you said 'yes I will do that' too many times when you were new and they started taking you for granted. So my advice would be forget about the discrimination as it may not be real and instead concentrate on your health issues and the light duties area. If they ignore your medical advice that is VERY serious and easy for you to prove.

Re: Need help and advice on violations of rights in the work
Concentrate on the medical side of your grievances as that is at least provable to a degree.
Forget the "discrimination" aspect as that's been worn down to the canvas by (insert race/ethnicity of choice) claiming it so many times over so many years that it's now all but meaningless without independent and verifiable third party accounts to back it up.
