Suspended for Social Media misuse

I've just been suspended for a post I made on Facebook complaining about not getting time off & management, stupid I know , don't know what I was thinking, am I looking at dismissal for gross misconduct ?

And the fact you have been suspended proves that they are indeed idiots. What would happen if we all grassed them up for the way they talk about our colleges behind their backs ? Nothing probably.. but we could.

It is shocking that you could lose your job simply for stating a provable fact, however that is the way of the world nowadays and none of us is allowed to criticise RM publicly and not face the consequences. This is the same in most jobs nowadays. The only way we can do it is anonymously through great venues like RMC. Do not use facebook to slag off our leaders if it can be traced back to you or viewed by the public.

I am particularly choosy on who I have on my Facebook and have removed people in the past where I have my suspicions, at the end of the day I wouldn't say anything that I couldn't defend in real life, I never have any mangers on my friends list ever, some of my colleagues do, which is asking for trouble

Regarding the OP, depending on what's been said as long as it's not defamatory and didn't name any specific individuals, nothing may come of this, I would advise the OP to prune his social media friends list and contacts.

The only way we can do it is anonymously through great venues like RMC.

I would hazard a guess that more people have lost their jobs over what they have posted on RMC than all the other social media sites put together.
Nothing is ever really anonymous.

Surely it would be nigh on impossible to prove the person who posted on Facebook is actually the employee? Anyone can set up a fake Facebook account up in someone else's name.

Probably many caught whining about their employers on Facebook have tried that very excuse, and they likely failed in the somewhat desperate attempt to deflect the blame, too. You think the departments etc set up for this very purpose are really that daft?
As so many employment lawyers, unions and the rest have said, unless you want to be claiming Jobseekers allowance, do not, under any circumstances and no matter what the provocation,criticise your employer on social media. It never ends happily...

If they had to prove "beyond reasonable doubt" then unless they got hold of the IP of the post from FB and the ISP you are right.

However, they don't have to prove it to such a degree. All they have to do is make a reasonable decision with the information available at the time. So yes they can discipline somone posting on FB as long as the decision is reasonable and that the investigation was also such.

So basically, anyone malicious enough to do so, could open an account in someone else's name, put said other person's picture as their profile pic, spout off about management and get that person fired, without reproach?

Possible but unlikely, the vast majority of social media dismissals involve the sharing of posts between colleagues because one of your work "friends" will have a manager as a "friend" or a grass. At the end of the day not having one on your own friend list won't save you unless you filter everybody who can repost your posts.
