moving days off to bank holiday
basically all the leave reserves in our office have had their days off move to bank holiday monday. they did this to us all at the last 2 bank holidays. our manager sys its fine and the union has aggreed to this practice. is this for real? since whe is it fine to treat leave reserves differently to posties with a duty. its unfair. surely if they do this they should do it to everyone. ive already asked if i can get any leui days in this year and the maneger says no. lol.

A majority of the bank holidays form part of our STATUTORY entitlement as reagrds leave. They cannot refuse you a statutory entitltment as its law and no-one is above the law.

We have this kind of thing going on and the area rep is in our office
So are you going to say go higher.
Basically reserves are discriminated against if your on that board say goodbye to any kind of life .Its about time this was addressed by the union .

Tell them you want overtime instead of the day in lieu which you are entitled to and you will find that they quickly stop changing your day off to bank holidays :-)

There are 3 choices after all.
1. Push the Union - go as high as you can via the appropriate chain.
2. Take it on yourself, help with colleagues where possible.
3. Complain but do nothing.

Ref: Complaint over annual leave allocation April 20xx to March 20xx
Dear Sir
Please accept my apologies in bringing this matter to your attention, but I feel a more formal approach is now needed off the record. It has become apparent that it is now an impossibility for me to book my statutory annual leave entitlement due to operational needs. This approach I believe is in contravention of my contract of employment and the express terms enclosed within that contract. This is particularly in reference to weeks that contain a bank holiday. When the weekly rest day for reserves is selected to be the bank holiday day, and then subsequently I cannot book a day off in lieu. I feel I must point out that bank holidays form part of our statutory entitlement to leave.
Statutory provision dictates that the employer does not have to agree to a particular leave request, but the employer must allow you to take your holiday at some stage before the annual leave year expires. A full time employee is entitled to a statutory minimum of 28 days leave a year. Part time workers receive a pro-rata entitlement. The Working Time Regulations, specific regulation 13(1) guarantees this right.
The way Forward agreement stipulates that a maximum of 5 days entitlement may be carried over by mutual agreement. Paid holiday entitlement is not a bonus granted by an employer, it is a legal entitlement to a break from the working environment. I have always stated that I am prepared to give adequate notice on my leave request, but this has also been declined.
I need to bring to the attention of the business that an employee can bring a claim to the Employment Tribunal Service under Regulation 30(a) that they have been refused the right to exercise their entitlement to annual leave under Regulation 13 and/or 13A.
This letter is an informal request as to an explanation as to why my request for statutory annual leave entitlement has been declined. As this is a statutory right, commercial or operational considerations do not apply in refusing that right. If the reasons given are reasonable and in accordance with English law, I will be more than happy to discuss this matter further for mutual benefit.
I respectfully request a meeting within 7 days of receipt to clarify the points raised.

If it suits you (the OPG, managers do not have a choice), claim today's bank holiday clash with a scheduled day off as "B H Excess" on the "day off" (green) overtime sheet, claiming for the normal amount of hours you would be contracted to work on Mondays.

i asked my manager if i could claim the overtime instead but he refused saying he doesnt have the budget. he said i will get a leui day but i cant take it because we have 5 vaccancies which hes refusing to fill until summer is over. i really just dont give a toss anymore.

Culture change my arse. Seems hq aren't that bothered about this kind of thing that's going on regularly in delivery offices. Same in our DO, every reserve was given Monday as their day off. I asked for a Bank hol excess payment so far being blocked and told loads of bullshit about why it can not be paid. then suggested I may get paid another way without it going through the books, which seems fraudulent to me.

I printed off the policie and produced it in front of the dom and area rep and was still refused the overtime,they could not offer me a day off on the same week so i asked for o.t but was refused and given the following monday off instead and i even had to push for that.

They didn't want to pay at my office about a year ago so I emailed moya Greene at justsayit@royalmail.com they emailed my office dom and said they must allow us to book it if we wish. It doesn't come out of the office budget that's what managers fear.
