But surely under the equality act we should not be put at a disadvantage and lose the bank holiday entitlement that everyone else got.

Equality act has nothing to do with paternity leave.

And not all of the bank holidays are part of your statutory entitlement hence there is no law being broken by not giving you these back as long as you have gotten at least 4 of the days back during the rest year(if 5 day a week worker)

the bottom line is you did not lose out, you were not at work, if you were not on paternity leave you would not have been at work

Had it been you rota day off THEN you would be entitled to get it back as you would have been off anyway

It's not quite that black and white, he has lost out on 3 days of annual leave on these bank holidays, unfortunately he has lost not lost any statutory annual leave which he would have been entitled to get back, as royal mail give us more annual leave than the minimum legal requirement he has not legally lost out but he has actually lost 3 days annual leave as don't forget that's what a bank holiday is its part of your annual leave entitlement
