A DOM has no legal qualification to over rule medical advice ever, this sounds like suspension fabrication of evidence to me, a legal minefield for the DOM making him vicariously liable, this is so wrong on so many levels, personally I wouldn't have told him anything I would have just gone of sick and let him deal with that. DOM these days seemed to be playing fast and loose with employment law with little understanding of the consequences. get the area rep in and don't take any crap and go off sick anyway.

I would be both shocked and very surprised if you lose your job as a consequence of this. You will probably receive a one year serious even that would be grossly unfair. In my opinion it would seem your DOM has taken a dislike to you. When people go sick it comes out of their budget, maybe that is a reason for him to try to dismiss you. Any tribunal worth it's salt would decide in your favour. What a nasty thing to fo at Christmas time, you could do without the worry and stress. What is the union doing about this? What are your colleagues doing about this? If he tried this at our office we would have walked in support of you. Then again we are a strong office situated in London and we stick together. Please do not go sick if you are fit enough for work. Ask for light duties if you can. What you must do is gather evidence concerning your injury that you can produce at any appeal or better still at a grevence hearing. Statements from atos and consultants etc. Dont forget pain, worry, medication would have contributed towards your alleged agrassive behaviour towards your DOM. Again get a note from your doctor stating this. Everyone in royal mail deserves to be treated with respect dignity and fairness management included. But suspending you especially at this time of year without taking into account the full facts regarding your health and all the opperations that you have under gone , as well as the worry of not even knowing whether or not you will be able to even return to work and still be able to continue to do such a physical and demanding job would also had been a contributing factor in your alleged agrassive behaviour, all this should have been taken into account when making the decision to suspend you.as well as taking into account your 20 + years work record. As I said, royal mail are not stupid they know any tribunal will take all of this into account and rule in your favour. This is way I truly believe they will not sack you. However they will try to disapline you, so when you appeal gather all your evidence regarding your injury and how it has also affected your metal wellbeing and you will win your appeal. Quick update... Still suspended not heard nothing still waiting but my suspension was up until today (Sat 3rd) not received any further suspension letter today so I'm officially not suspended now is that right? how does this procedure work? its twice now where i have been suspended up to Saturdays then the suspension runs out on that day then I get letter on Monday but surely Im eligible to walk into the office first thing Monday? Anyone can help on this procedure please?

Usually they will either telephone or send a letter to you when they have lifted the suspension,as they have twice already sent you a letter on the Monday afterwards then unless you have received a phone call today I think it is fairly safe to say your still on suspension.

Your letter should look like this:

Dear

You were suspended with pay on (date).

I have now further considered the matter and I have decided that you should remain
suspended with pay / return to duty* as from (date).

The reason for my decision is (provide reason(s)).

The suspension will be reviewed again on (date).

NOTE TO MANAGER: * Delete as appropriate

The letter clearly should either give you a from date & review date or a return date.

It doesn't tell you when your suspension remains until; that would only be implied by a given return to duty date.

Additionally your original Suspension Letter should have stated:

You will be contacted in due course, but in no circumstances should you attend for duty
or visit Royal Mail premises unless instructed to do so.

Charged with Gross Misconduct on Monday. Both managers have wrote entirely different statements and full of lies. looks like dismissal according to the paperwork unless I can prove myself not guilty but what chance do I stand against two and I have no witnesses?

surely if their statements differ its got to be suspect. something to hide or being set up to take a fall looks likely. what does the rep say.

I'm surprised that they have written entirely different statements as they usually all sound amazingly similar as they never collude together or discuss it with each other.

The usual reasonable belief bollocks will be trotted out.
