Employers can say when employees take rest breaks during work time as long as:

the break is taken in one go somewhere in the middle of the day (not at the beginning or end)

So your manager can tell you when to take your break,as long as it's in the middle of the day!!

It doesn't say it has to be in the middle of the day.
It says "somewhere" in the middle of the day, which is a fairly loose and open to interpretation wording.
It simply cannot be at the beginning or at the end of a shift.

We have collective bargaining. Our union agrees certain things with our employer. One of those things is the meal relief.
The duration of your meal relief is covered by a national agreement.
The timing of the meal relief is decided at local level. That means the rep discusses it with the members and with the managers and they arrive at a decision that must be in line with all national agreements and in line with the law.
If the members vote for a 20/20 split (because they want to get home that little bit earlier) one member of the staff cannot decide they want to take the full 40 minutes prior to dispatch. It isn't a personal decision.
If the members have decided to take the break 3 hours into an 8 hour shift, because they want to have the meal relief inside and not out in the van or the rain, then that would be regarded as "somewhere" in the middle of the shift and that would be the agreed break time. One member of staff couldn't decide they wanted their break exactly 3hr 40 into the shift because that was in the middle of the shift. The employer could insist they take their break at the agreed time. It isn't a personal decision.
Neither can someone decide to skip their break because they want to finish 40 minutes earlier. It isn't a personal decision.

Your entitled to take your full 40 minutes before you go out, but 20 mins minimum before you go out. It's your decision.

You can tell your employer when you are going to take your break.
I remember now last time I was on a train from Glasgow to London - the driver stopped just outside Warrington and announced he was taking a 30 minute break, as was his right as enshrined in law.
The societies of consumption and squandering of material resources are incompatible with the idea of economic growth and a clean planet.

Yes in charge of a moving vehicle you should have a break before five hours after start of shift and not go over five hours without a break so equidistant and have one day off in 11 days.

Doesnt that contradict with "the break is taken in one go somewhere in the middle of the day"

That wording suggests we`re entitled to the full 40 minutes in one go, whether or not its been agreed as a 20/20 split. Sure, they can say WHEN we take it, but at that time the whole 40 minutes can be taken if that person wants to.

The pattern of meal relief is decided by the office as part of the revision process when the duty content is planned. It isn't an individual decision. Try walking off the IPS and telling your manager you've decided to change your meal relief pattern, see if you end up in the canteen or the manager's office.

Clash, meal reliefs are different under p&l if you work with p/ter, f/ter entitled to 40 mins, where p/ter only entitled to 30 mins. Just another flaw of p&l.

The Working Time Regulations only apply to a 20 minute rest break. There are no regulations covering the other 20 minutes only a collective agreement (Way Forward) that states that breaks of 40 minutes and above can be split and are subject to local agreement.
