Accused of willful delay

Royal mail ignored acas, they said original dismissal stands however they also mentioned that they would be prepared to provide a good reference without the mention of gross misconduct provided I did not continue with an employment tribunal. Unsure of RM motives here, as anybody come across this before. I have 48 hrs to make a decision.

Do you trust them to give you a good reference when they have fabricated evidence against you?

Exactly what my husband said, thought it was strange that they would drop gross misconduct on reference if did not progress with ET. Husband said it appears RM is managed by incompetent untrust worthy bullies!

He is right but it is up to you how you go about this with the help of your husband all I can do is wish you the best and hope the outcome for you is just and fair.

I'd be interested to know exactly what that is. As for the Rep although it is true that it is your decision he must surely have an opinion having probably seen the ins and outs of a tribunal before and what percentage the outcome might be. Still it is a juncture and one that I would be reluctant to face without some really good advice from an employment solicitor.

Been reading this thread for a while.

RM are trying to roll you over with threats. If you do 'A' we will be nice to you. If you do 'B' we will take you down.

Please do 'B'. Even if it hurts ; as RM should not be allowed to get away with this crap.

Good move mildred - as for the reference, about as much use as a chocolate fireguard

Well its over, spoke with solicitor. He looked at all the information I had and gave me his professional opinion. In a ET case the board sitting will look at the following - have RM followed the correct procedure's and adhered to policies, have they all the documents, evidence and witnesses. RM in any investigation will take the position that you are guilty and will build there evidence, witnesses and documents to prove this (enhance they always state in formal cases - I/we believe or in my/our opinion). It is the responsibility of the accused to prove there innocence. If RM have not followed policy and procedure you win, if they have they will go to ET with opinion they will win.
ACAS are a complete waste of time and do not really achieve anything, they do not have any power to take on large corporate companies. However spent most of today with the union and a deal as been brokered, not exactly what I had initially hoped for but its a lot better than what I had originally been offered. I cannot say what that is as I have signed a confidentiality letter, but let's just say agreement as been made that I was innocent and certain others are not. I have a young family and after some serious thought i cannot put my family through anymore, we go on holiday next month and want to enjoy it without worrying about a crappy company like RM, finally i can put a line under this and move on, I want to thank everyone for there support and advice.

All i will say is if they were willing to settle pre tribunal you had em.
I get the bit about stress though.
