Have been looking in on this thread... probably the single worst abuse of power by RM management I have read on here... clearly a case for unfair dismissal based on the facts provided... surprised you did not win your appeal as whether appeals are successful or not are based on whether the business believes it will win or lose at Tribunal... having been through the process myself while still employed by the business I was advised that cases are always stronger if you have in fact been dismissed... get your ET1 in asap and take advice from the CWU legal team... if they do not support your claim do not be disheartened as unfortunately from my experience this is often the case... a solicitor outside the CWU assigned legal team will offer equally good advice (if not better)... it's worth noting that the CWU will pay for your ET1 claim (£250?)... you may not want your job back but part of your case will be for loss of earnings... good luck whatever you decide to do...

ps some house insurance policies cover legal fees... worth bearing in mind... :thumbup

Is it just me but it seems rm management are getting progressively worse. I cannot believe how many posties have real grievances with management who appear to be able to twist and bend the rules to suit there own needs. RM in my opinion as turned into a us and them type of company which my husband says cannot be good for business. Moral at my DO is at an all time low. Anyway onwards and upwards, acas form in/et form completed, as they say lets get ready to rumble!

I have a telephone interview with acas on Wednesday asking me to provide facts of my case. Is it usually conducted over the phone or is this just the preliminary part of acas intervention. Any advice on dealing with acas or with ET is gladly appreciated

Royal Mail will ignore ACAS if

1) You are awaiting an appeal decision
2) You lose the appeal

Waste of time but must be done.

Royal mail ignored acas, they said original dismissal stands however they also mentioned that they would be prepared to provide a good reference without the mention of gross misconduct provided I did not continue with an employment tribunal. Unsure of RM motives here, as anybody come across this before. I have 48 hrs to make a decision.

Do you trust them to give you a good reference when they have fabricated evidence against you?

Exactly what my husband said, thought it was strange that they would drop gross misconduct on reference if did not progress with ET. Husband said it appears RM is managed by incompetent untrust worthy bullies!

Unless I'm mistaken, the 'employer' should not give a 'bad' reference, they can either provide a 'good' reference or refuse to provide one.

Please do not take your advice from anyone here on Royal Mail's offer, I really do feel that this is 100% down to you to decide with the full support of your husband. It's a very clever offer which keeps the door open for you to fight on but lets you know if you fail that you could potentially never get another position elsewhere.

Exactly. No employer is allowed to give a bad reference, they can only politely refuse to give one. And as you wouldn't give details of someone that won't give a reference anyway seems rather silly.
Don't know the in's and out's of you're case but to me it does sound like a very poor offer. What does the rep say about this.
