How to fight the dismissal

Mate - sorry to hear about your personal problems I really am.

But you have to fight them and that means contacting the union asap. You must remember to get your ET1 form submitted to your local Employment Tribunal office - there is a strict timetable for this and even if received a day late it is rejected no matter what the circumstances - a postal dispute is also not an acceptable excuse btw. The time limit for submission is three months and starts ticking from the date of your dismissal.

You can apply online and there is all sort of info at http://www.employmenttribunals.gov.uk but I recommend you see the union first before you do anything.

Publicity is a great idea but don't do it directly yourself - get your partner to do it or a 'friend of the family'. You know the kind of thi ng the 'friend' tells reporter that you are gutted and lays out the whole story but it isn't coming from you so RM can't use it to have a go at you at the tribunal.

Good luck - but don't give in - I know your head will be up your ass just now but don't let them away with it.

Take them to the feckin cleaners. Stand up for what's right. RM are hoping you'll just back down and accept what you've been given.
I know how the slimy pr**s work. I used to have a manager who was a complete C-U Next Tuesday. He used to really lay in to the newest members of staff as they didn't know the full rules and regulations. Management will also play on the fact that you don't want to jeapordise your future employment.

The manager knows sweet f a cause even if you are sacked when companies write to rm for a reference they only say that joe bloggs worked for us from x 2 y nothing else.

You should get the union to put forward the case of Dosemestic Distress you can get a weeks unpaid leave for that.

Sorry to here you have had a rough time James sadly its a harsh reminder of how the buisness are treating people (Our People) I think is the phrase the caring sharing company. NOT>>>>> Chin up mate your prabably better off out of it more often than not you here of people sacked on a Three or forced to reisgn that look back on there time with the buisness and wonder why they put up with for so long. Dont give up the fight if you feel like you shouldn't you can cause an awful lot of paper work on appeal should you need to get back there retract your resignation Brother...USE THE FORCE LUKE sorry James

hi james. sorry to hear about your problems. like everyone else on here i think you should fight it all the way. have you tried your g.p ? he/she might write you a letter stating that you were in no fit state of mind to attend any interview. i presume rm made first contact for you to attend one. may help with any tribunal. good luck mate. you deserve some.

It doesn't sound right to me. To be fairish to them, if I were managing someone and they disappeared without contacting me for almost two weeks, I'd probably have asked for their resignation as well, but it ALWAYS has to go through the proper channels - which, thankfully, they often neglect to do, and therefore, their incompetency empowers the worker.

Doesn't the manager have a responsibility for finding out if you were alright?
I think you should fight it too mate - if you are up to dealing with the hassle. I think in previous posts you said you had been in the Forces and had served in Afghanistan. If so you should use that to get publicity in the local press - and national press if you can. Doesn't look to good for RM does it, sacking someone who has served their country.

I would think a manager - anyone's, not just RM, has responsibility for checking that the person is OK if they're not in contact - for example, they may live alone and have died in the night... wouldn't look good if work hadn't even tried to get in touch...

If it were me I'd say I TRIED to get in touch but couldn't get through - god knows u can't at our DO. That way u are showing good intentions on your part. Even so I understand u were enduring SEVERE personal turmoil. You have been v badly treated esp if this manager was aware of your hardship. You should have been retrained and warned.

correct !-duty of care , can't have RM's corporate image being damaged can we now ? , RM are quite keen on showing duty of care for non-union, manager's friends/relatives , strike breakers , anybody who could make somebody else look good & earn brownie points for . Also there's our caring managers sending us all those letters of support , making welfare calls , making sure we get back to work soon as it's only because they don't want us moping round the house etc and back amongst the one big happy family . They even make sure we go to see the improved Health Care professionals and threaten to stop our wages as they don't want us spending it on the wrong things and even pop round uninvited to see how we are or tell us to pop in for informal chats .

The improved health care professionals only accuse of malingering as they don't want us all to be feeling sorry for ourselves and our mediocre middle & junior management are such experts in medical science , they certainly know how to get time off that's for sure .If RM make things difficult it's only our welfare they have in mind as we're in the wrong job, and it's for our own good.

I'll have to send this post to postmanscab & the courier , my only worry is plenty of their members have already posted similar ones to this one . RM will be telling us Santa Claus exists judging by their patronizing, condescending propaganda .

I'd play the patriotic card as well. RM are only interested in running a once proud institution into the ground for New lie-bour to sell to the German's & the Dutch. RM with thier imbecillic political correctness are only interested in impressing Toy Town Liberals who hate this country. RM do a wonderful job recruiting for the BNP though ! by choosing to ignore the lame & lazy for brownie points .
