MTSF will most likely change in any new deal that may be signed between union and management from what i have heard again just a rumour something will replace MTSF but the terms for leaving the business will be reduced, an april deadline is most likely to be used from switching from one to another if MTSF changes and management have definately signalled their intention to do so that is not a rumour they feel MTSF is unsustainable in a commercial environment their words not mine.

What RM plan for you, as cheap as possible ?
We had the bare minimum state terms with the NUR and the employer had the nerve to say that you may not get redundancy as it might be oversubscribed . Also you had to have a letter in case the DHSS tried to make out you "left" your job "voluntary".TrueBlueTerrier wrote:They are getting rid of MTSF

LEGALITY
You are entitled to redundancy pay if through no fault of your own , your job ceases to exist or changes fundamentally that it is no longer your job as you have known it . In practice , this arises in four different types of situation
1 All or part of your employer 's business closes down , the employees become redundant if not given suitable employment elsewhere
2 The Business is moved but not if there's a mobility clause
3 The Business is sold or taken over . The Thatcher Government had to enact the TUPE ( Transfer of Undertakings )( Protection of Employment ) Regulations due to a EEC directive
4 Your Work is reduced . R eorganisation etc only create a legal redundancy if the amount of work is reduced . Merely changing the hours is not sufficent .
If you are laid off or put on short time you can declare yourself redundant by writing to your employer , you are entitled to time off to look for another job under Section 52 & 53 of the 1996 Employment Act .
ENTITLEMENT BARE MINIMUM STATE TERMS
1.5 weeks for each year between 41 & 65
one week between 22 & 41
half a week between 18& 22
Be careful people have been sacked just before the age trigger points in the NHS & Civil Service and have had to go to ET . RM will probably try this on.
The 1996 Act states that you should recieve all your pay on the last day but the Employer can stagger it "within a reasonable time". RM have tried this one to make it go on the next tax year . "Mistakes were made"-B*****ks
A Employer must warn and consult any employee affected ( Statuary Notice Period ) - Watch RM on this one , they've always tried this on ,in case people go sick before getting the boot.
This information is relevent as AG's have been told they'll recieve the bare minimum state terms . RM have not put people on fixed term contract or TC's for nothing .
