Ok so basically you were accused of theft, rather than fight it you chose to resign instead of waiting to be sacked, that was three years ago
You have since attempted to work for royal mail again via angard, you were spotted and subsequently stopped from working with them, also several direct job applications have been refused, regardless of how long the manager has been in position that decision is a reasonable one to make
The details of breach of dpa etc dont really matter in this for getting your job back, yes they would have given rise to a legitimate grievance at the time and would have been legitimate factors to argue for keeping your job at the time, but you chose not to pursue that course of action and chose to resign instead, 3 years down the line you are going to get no where on that side of things
However over and above all that you decided to take the accuser to court and have won your case, which has basically proven your innocence, but because you have waited so long there is no legal duty for royal mail to give you your job back, there is no legal requirement for them to give you a new job either, you should not have waited so long to try and get this sorted out
Also you say you got a 4 figure payout, this should have been an awful lot higher, you lost your job because of these allegations, lost your source of income, even 1 years worth of income is into 5 figures you seem to have been let down by your legal team
My only advice would be to get someone to write out everything that happened in a clear concise manner, scan a copy of your court win and email it to justsayit@royalmail.com that will get it to the top of the tree and hopefully your best chance of getting a job back, but remember at end of the day you resigned rather than fighting, if you had fought it at the time you would be in a better position

thanks zx135...I did at the time after resigning gain advicefrom HR team in sheffield there advice was submit a modified greivance did this dsm reply came back basically ....off , before he replied to me he also contacted hr to find out from what they had advised me and advice for himself there answer to him was to give me another meeting but this he was not prepared to to in his reply ...I only know all this now as I asked from the data ream if telephone calls are recorded so I had the ones I had made but I take it because this one also concerned me and data protection etc it came back as well ..so I do have this as evidence I think this is what everyone seems frightened of as no one else will have these now as the data team say they would be destroyed by now ...I dont think the dsm knows I ever even had it....any further help would be good...

regardless of any advice given to you or the DSM 3 years ago by HR and regardless of whether you got a copy/had a copy of the call recording, you chose not to fight it then and resigned, because of that there is no way to fight it now you have left it far far to long, if they were in the wrong the time to get it sorted was three years ago or at the most shortly after your court case in 2011, you waited to long, your only option is really to ask at the top for it to be reconsideredsteves pants wrote:

thanks for that yes I know looking back I should have dealt with it back then ,, but in a way I sort of moved on got another job within 6 weeks of resiging ,, it was only in dec 2012 ii thought I wpuld call HR and see and see what my status was on the psp system reason for leaving was told voluntary resignation only so I was able therfore to appluy for jobs and as you know this i did ...but what has now come to light in an SARrequest from the data team are remarks made by various persons about me that unless they can prove other wise are lies....these remarks etc were made in the last 9 months...but I only asked for the SAR in january 2014...
these remarks/comments have even got to a prospective employer in the last 2 months...

will try to get local branch to help !! they do seem a bit reluctant at times, as you have seen yes they did get all papers etc hat I had back as my SARto the legal team, who sent a letter to branch taken a month for it to be forwarded back to me.
Yes I know the problem was a long time ago that it started but after leaving got employment very quick after resigning which was good, it wasn't till xmas 2012 I started askin questions at HR as to my status and was told I was ok etc, no security issues etc got job with angard etc as you know , this was then when RM realised they hadn't done all of there leaving procedures that they should have done ,,, But security say that I am not a securirt risk as it wasn't a mail related theft so they cannot add me to the risk recruitment register which managers seem to keep trying to do but they won't let them do it ,, my ex dom even put one in last year after he saw me working ,, this one by sec has been destroyed since then another has been put in and again this one has now been destroyed ...thanks
